Staff Analysis: Z-6566 Mabel Kelley 2209 Boulevard Avenue Lot 3, Biniore's 8, Block 2, Hyde R-3 Subdivision of Lot Park Addition Variances are requested from the area regulations of Section 36-255 to permit construction of additions with reduced front yard and side yard setbacks. The proposed addition will maintain the existing side yard setback. The addition to the front will still be located 30 feet from the street. Single Family Single Family The R-3 zoned lot at 2209 Boulevard Avenue is occupied by a small, one-story, frame, single-family residence. The home has an attached carport with a side yard setback of 2.7 feet. The Code requires a side yard setback of 5 feet for this lot. The applicant proposes to substantially remodel the home including enclosing the carport to convert it into a garage, adding a 12' X 14' addition to the rear of the carport/garage for a new bedroom and adding a 10 foot addition onto the front of the house for an enclosed porch and another room. The bedroom addition will maintain the existing 2.7 foot side yard setback. The addition onto the front will result in a front yard setback of 21 feet. The Code requires side yard and front yard setbacks of 5 feet and 25 feet respectively for this lot. September 28, 1998 Item NQ.: 9 Cont. Staff believes the variance requests to be reasonable. Allowing the enclosure of the carport will not increase the impact of the reduced side yard setback. Permitting the proposed bedroom addition to maintain the existing 2.7 foot side yard allows for adequate separation between this,home and the home on the adjacent lot. 2.7 feet allows for maintenance of the structure without encroaching on the neighboring property and should not create a water run-off issue. The proposed 21 foot yard setback should also not create a negative impact on adjacent properties or on,• traffic in the street. Boulevard Avenue, at this point, is a 1 1/ block dead end street, ending at a point 150 feet north of 24`h Street. The porch addition will set back 33-34 feet behind the street curb. C. Staff Recor=endation: Staff recommends approval of the requested side yard and front yard setback variances subject to compliance with the following condition: 1. If the roof of the carport and proposed bedroom addition slopes toward the property line on the north, guttering must be installed on the north end of the addition to prevent water run-off onto the neighboring property. BOARD OF ADJUSTMENT: (SEPTEMBER 28, 1998) The applicant was present. There were no objectors present. Staff presented the item and a recommendation of approval subject to the following condition: 1. If the roof of the carport and proposed bedroom addition slopes toward the property line on the north, guttering must be installed on the north end of the addition to prevent water run-off onto the neighboring property. The applicant offered no additional comments. The item was placed on the Consent Agenda and approved as recommended by staff. The vote was 4 ayes, 0 noes and 1 absent. E
