area regulations of Section 36-299
to permit placement of a previously
approved television/radio tower
with reduced setbacks.
The terrain and proposed site plan
dictate that the proposed tower be
moved to this location.

B. Staff Analvsis:
On September 28, 1998, the Board approved a height variance
to allow Citadel Communications Corporation to construct a
199 foot tall television/radio tower on this C-1 zoned
property in conjunction with a 20,000 square foot building.
Citadel proposes to consolidate its multiple radio station
operations at this one location. Further study of the site
and the resulting slight revision of the site plan has
caused the tower to be moved closer to the southwest corner
of the property. The tower is now proposed to have a side
yard setback of 9 feet on the west and a rear yard setback
of 4 feet.

The Code requires a side yard of at least 10 feet and a rear
yard of at least 25 feet in the C-1 district.
Staff believes the variance request to be reasonable. The
abutting properties to the west and south are also owned by
the applicant, Winrock Development Company, who is selling
this site to Citadel. Winrock supports the requested
variances. A mini -warehouse development has been proposed
for the property to the west. No development has been
proposed for the property to the south at this time. The 1
foot side yard variance to allow a setback of 9 feet should
have no impact on the adjacent property to the west.
Although the bulk of the tower is located within the 25 foot
rear yard setback, it is a minor encroachment in the larger
scope of this 280 foot wide property.
C. Staff Recommendation:
Staff recommends approval of the requested side and rear
yard setback variances subject to compliance with the
following conditions:
1. Compliance with Public Works Comments
2. Compliance with the following conditions imposed by the
Board when the tower height variance was granted on
September 28, 1998 (File No. Z-6564).
a. The tower is to be a neutral color such as light
blue/gray to more easily blend with the skyline.
b. Compliance with Public Works comments
c. Compliance with any applicable FAA regulations for
lighting the tower.
d. There are to be no signs or,logos on the tower.
e. Compliance with the City's Landscape and Buffer
Ordinances.

The applicant was present. There were no objectors present.
Staff presented the item and a recommendation of approval subject
to compliance with the following conditions:
1. Compliance with Public Works comments.
2. Compliance with the following conditions imposed by the Board
when the tower height variance was granted on September 28,
1998 (File No. Z-6564).
a. The tower is to be a neutral color such as light
blue/gray to more easily blend with the skyline.
b. Compliance with Public Works comments
c. Compliance with any applicable FAA regulations for
lighting the tower.
d. There are to be no signs or logos on the tower.
e. Compliance with the City's Landscape and Buffer
Ordinances.
