Justification: A licant's Statement: The
proposed room encroaches on the 35
foot building line as shown on the
enclosed survey. At its greatest
point, there is still 26 feet to
the property line and 36 feet to
street curb itself. The room
addition cannot be placed any
further back from the street due to
construction requirements of the
roof line. Also, I have carefully
reviewed all of the other possible
sites on the property and they are
not suitable for the addition due
to aesthetic and/or construction
considerations.
The addition itself will be of high
construction quality and blend
nicely with my home and
neighborhood. No trees will be
removed on the proposed
encroachment or anywhere else on
the project.

Remove deck from drainage easement at northeast corner of
property.
Staff Analysis:
The R-2 zoned property at #2 Masters Circle is occupied by a
one-story; rock, brick and frame, single family residence.
The applicant proposes to construct a 600 foot addition onto
the north side of the residence. The addition will exceed
all required zoning setbacks but will cross a platted 35
foot building line on the Masters Circle frontage. The
applicant is requesting approval under Section 31-12 to
permit the building line encroachment.
Staff believes the request to be reasonable. The property
is a corner lot and the house does not sit parallel to
either street. The house is angled on the lot so that it
faces into the intersection rather than facing directly to
either street. The addition is constructed to conform to
the home's roof line and interior lay -out. Due to the angle
of the home in relationship to the lot line, a small portion
of the addition crosses the building line. The encroachment
involves only a corner of the proposed addition and should
have no impact on adjacent properties. The addition will
have a front yard setback of 26 feet and will set back from
the street approximately 36 feet. It was noticed by staff
that a portion of the existing home currently encroaches on
the building line to a degree very similar to that proposed
for the new addition. This Board action will address that
situation as well as the proposed expansion.
Should the Board approve the building line variance, the
applicant will have to do a one -lot replat reflecting the
change in the building line. The applicant should review
the filing procedure with the Circuit Clerk's Office to
determine if the replat requires a revised Bill of
Assurance.
Staff Recommendation:
Staff recommends approval of the building line variances for
the proposed addition and for the existing home subject to
compliance with the following conditions:
1. A one lot replat reflecting the change in the building
line as approved by the Board.
2. Compliance with Public Works comment regarding removal of
the deck from the drainage easement.

The applicant was present. There were no objectors present.
Staff presented the item and a recommendation of approval 'subject
to compliance with the following conditions:
1. A one lot replat reflecting the change in the building line
as approved by the Board.
2. The structure in the drainage easement is to be removed if
it is found to impede water flow.
(NOTE: Condition no. 2 was changed by the Public works
Department after further review).
The applicant offered no additional comments.
The item was placed on the Consent Agenda and approved as
recommended by staff. The vote was 4 ayes, 0 noes and 1 absent.
