Sincerely, Donna James, AICP Subdivision Administrator ORDINANCE NO. 19,733 AN ORDINANCE REPEALING ORDINANCE NO, 19,479 AND REVOKING A PLANNED ZONING DISTRICT TITLED BOWMAN KANIS RETAIL CENTER LONG -FORM PCD, LOCATED ON THE NORTHWEST CORNER OF KANIS AND BOWMAN ROADS (Z -6554-E) IN THE CITY OF LITTLE ROCK ARKANSAS; AND FOR OTHER PROPOSES. WHEREAS, Ordinance No. 19,479 was adopted on February 7, 2006, establishing a planned zoning district; and WHEREAS, the owner of the subject property has requested the repeal of the "PZD" ordinance and restoring of the zoning classification as previously existed. NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That Ordinance No. 19,479 is hereby repealed, removing from the official zoning map the classification PCD titled Bowman Kanis Retail Center Long -form PCD, located on the Northwest corner of Kanis and Bowman Roads (Z -6554-E). SECTION 2. SECTION 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. SECTION 6. It is hereby determined by the Board of Directors of the City of Little Rock that there is immediate need to revoke the PD -R zoning classification for the Bowman Kanis Retail Center Long -form PCD, located on the Northwest corner of Kanis and Bowman Roads (Z- 6554 -E). An emergency is therefore declared to exist and this ordinance shall be in full force and take effect from and after its passage and approval. (Z -6554-E) Submitted by: Department of Planning and Development Action Required I Submitted By 4Ordinance Resolution Approval Information Report Bruce Moore SYNOPSIS The applicant requests that the existing PCD zoning be revoked and the property revert to its original R-2, 0-3 and C-3 zoning classifications. FISCAL IMPACT None. RECOMMENDATION Staff recommends approval of the requested revocation. The Planning Commission voted to recommend approval of the revocation request at their March 1, 2007, Public Hearing by a vote of 9 ayes, 0 noes and 2 absent. CITIZEN Notices of the public hearing were mailed to all residents PARTICIPATION located within 300 -feet of the site, all owners of property located within 200 feet of the site along with the John Barrow Neighborhood Association and the Gibralter Heights/Point West/Timber Ridge Neighborhood Association. BACKGROUND On January 5, 2006, the Commission approved a preliminary plat for a larger area which included this site. Proposed Lot 1 would remain zoned C-3, with conditions allowing a reduction in the previously imposed no build BACKGROUND CONTINUED area. The approval allowed future development to be construct nearer the "hard corner" of Kanis and Bowman Roads. The Board of Directors approved this request by the adoption of Ordinance No. 19,477 on February 7, 2006. Lot 2 was rezoned from R-2, 0-3 and C-3 to PCD. Lot 2 was proposed for the development with a retail shopping center containing 123,860 square feet and a total of 617 parking spaces. The Board of Directors adopted Ordinance No. 19,479 on February 7, 2006, establishing Bowman Kanis Retail Center Long -form PCD. The applicant's request is now to revoke the PCD zoning classification for this site. The site has not developed and the applicant is requesting the current PCD zoning be revoked and the original C-3, 0-3 and R-2 zoning classifications be restored. Per Section 36-454(d) the Owner may for cause request repeal of the ordinance establishing the development. OA I ORDINANCE NO.
