I have 2 motives for writing you today. 1. My commitment to the continued betterment of the Little Rock area and 2. This location is very close to my own personal community. My issues are as follows: 1. By no stretch of the imagination is this use suitable for this area. Strippers, burlesque dancers or not, There is an adjoining residential neighborhood and a family owned business directly across Dixon from it. The only fathomable reason for placing such a business here is to attempt to be (off the radar) in regard to regulatory agencies and authorities. 2. In the application staff states that the nearest single family residence is 290'. A private club is not to be placed within 750' of a single family use. Let's be honest... this is simple trickery. The developer is attempting to change a C-3 use (suitable for this location, although C-2 or industrial would be more appropriate) to a Planned Development in order to get the commission to approve his club to be less than 300' from families with children! I pray that the commission sees through this and holds firm to the designated zoning and therefor restrictions. 3. I'm guessing there may not be many commissioners that regularly travel this section of Arch street as I do. Adding a night club of any kind to this area of Arch street or Dixon, bath busy and narrow 2 -lane roads, would be ridiculous and extremely dangerous. 4. The increase in noise, crime, wrecks, and general filth alone should be enough to stop this application from proceeding. The residents of England Acres deserve for the current zoning to be maintained and therefore the protections offered to them. Their homes have been there since the early 70's. It would be a serious disservice I and injustice to them for the city to allow a zoning change on adjoining land that allows a "lower" use than what they accepted upon purchase, specifically a use non -conducive to a family environment. 5. I cannot imagine the city would have any motivation or justification whatsoever to change this zoning at this time. I can understand that there are circumstances for which this allowance should be made. For instance Otter Creek was once held a private club to serve our residents a full bar menu. However, the entire purpose of this zoning request is not to (serve the people), it is to circumvent P['t the families unrl kA=.•.=pr►a�Yr. r�.. However, should it advance, I will be a fierce and vocal advocate for those innocent families, homeowners and business owners who would be devastated by this development. Property is adjacent to an existing residential neighborhood called England Acres. There are young children/adults living in the neighborhood who walk past the proposed club location to the local Dollar General and Arch Street Pharmacy on a regular basis. The Club will be approximately 300 feet from residential homes. Per City Ordinance Chapter 36 Article V, Division 4 and Article II, Division 4: the intent is for Private Club facilities to be located 750 feet from residential areas. The proposed location in the application does not meet this Code Requirement. 2. The facility is located in Union Township which is a DRY AREA. 3. Per James Nowden with Pulaski County Special School District Transportation, there are 10 bus routes through this intersection each morning and afternoon. Children are being transported to the surrounding schools of Mills High School, Mills Middle School, and Landmark Elementary. Children will be continuously exposed to the club facilities every day which is not a positive vision for them of our community. 4. Primrose Day Care operates a bus through this same intersection each afternoon picking up children at Landmark Elementary School and transporting them to their facility on Dixon Road. The rezoning will not have a positive vision for the community regarding health, safety, morals, and prosperity. S. The application states that the facility is Similar to Twin Peaks and Hooters — NOTA TRUE COMPARISION. The interior construction of the facility, as described in the ABC documents and in the Rezoning Application for the business to be constructed at this location, indicates the installation of raised floors for female entertainers and a VIP area on the second floor for customers. Sky Bar is NOT SIMILAR to Twin Peaks and Hooters based on following comments: a. Hooters: Per Stanley Conrad, General Manager, L There are no raised stages for entertainment in their facility. ii. Ladies do not dance on stages or tables for customers. iii. Ladies do not remove any articles of clothing during their work hours. iv. Their main revenue is from sale of food and not alcohol. v. Hours of operation is 11AM to 12AM vi. Not a private club. b. Twin Peaks: Per my visit and conversation with management L There are no raised stages for entertainment in their facility. ii. Ladies do not dance on stages or tables for customers. iii. Ladies do not remove any articles of clothing during their work hours. iv. Their main revenue is from sale of food and not alcohol. v. Hours of operation is 11AM to 12AM vi. Not a private club. c. Sky Bar proposed hours of operation: 11AM to SAM. 6. Application states property owner is Choice Equity Investments LLC who is located in Benton Arkansas. Per ABC documents related to the property location and permits for alcohol, the property is being leased to managing agent - Billy Pope. Mr. Pope is a resident of Bryant, AR. Neither the company nor Mr. Pope reside in the local community for which they propose this facility. They are wanting to construct a business that will not benefit the community but to destroy the existing health, safety and prosperity atmosphere of the community. Per Municipal Code Chapter 36-296, facilities are "designed to promote and protect the health, safety, morals and convenience, order, prosperity and other aspects of the general welfare." The proposed rezoning for the described business does not meet the intent of the Municipal Code Chapter 36. 7. In the ABC Documents: "Mr. Pope testified he worked for the prior owners of Visions Cabaret, Sensations, and Illusions. He testified he also had dealings with club now known as Paper Moon." Based on his statement of experience in operation with these type of clubs, practicality is an indication of the type of business Mr. Pope through Choice Equity Investments will bring to the local community. Amore accurate comparison of Sky Bar to similar businesses is to compare it to Paper Moon, Visions Cabaret, Sensations Gentlemen's Club, and Peaches Gentlemen's Club. These are all similar private gentlemen's clubs in the Little Rock, Pulaski County, and Jacksonville area. Below is a comparison of these clubs to the type of activities Mr. Pope/Choice Equity Investments plans to bring to the local community. The following statements are based on police data from Little Rock Police Department, Pulaski County Sheriff Department, and City of Jacksonville for the last four (4) years of police calls to these similar clubs: a. Paper Moon: 289 police calls (6 calls/month) b. Visions Cabaret: 133 police calls (2.8 calls/month) c. Sensations: Gentlemen's Club: 165 police calls (3.4 calls/month) d. Peaches Gentlemen's Club: 199 police calls (4.2 calls/month) (Copy of police records are attached for ready reference) Based on this data, the proposed facility will bring everything that is OPPOSITE TO PROTECT THE HEALTH, SAFETY, MORALS, ORDER, AND PROSPERITY OF OUR COMMUNITY. Bottom line is I do not want, our community does want, nor does our community need this type of business because it does not meet the intent of Municipal Code 36 which emphatically states a facility is "designed to promote and protect the health, safety, morals and convenience, order, prosperity and other aspects of the general welfare." I am completely opposed to this type of business being placed in our community due to the negative effects it will have on property value, crime rate increase, and overall well-being of the people, churches and businesses nearby. This type of business will not promote the health and welfare of the community or local businesses. Our community already has many people who struggle with drug and alcohol addiction which affect not only themselves but countless others around them, including their own children. We most certainly do not need a business built from the ground up that PROMOTES the degrading of women's bodies as a visual commodity to be sold, which in turn helps with the lucrative selling of alcohol. Once again, I am completely opposed to the rezoning of this location and building of said "Sky Bar". I would gladly speak out against this vocally if necessary. I, along with many others I have spoken with in this community, believe this type of business will create a bad public image for the adjacent England Acres neighborhood (in which I personally own 8 lots) and the neighboring businesses (in which I also own and operate one directly across the street from property named Chuck's Surplus). It is a well established fact that these types of businesses foster drugs, prostitution and other criminal activities that we strongly oppose in our neighborhood. It is also my firm belief that this establishment would negatively impact my business, other business and property values nearby. I am writing to express my extreme distress over the rezoning request by Choice Equity Investments to change 10305 Arch Street Pike from C-3 and OS District to PDC. I urge you to deny the request. England Acres is immediately adjacent to the site. It is a low -crime, family-oriented neighborhood with a mixture of retired residents and families with children. The plans for the Arch Street location would radically change that. A "Gentlemen's Club" with alcohol, loud music and scantily clad women operating until the wee hours of the morning is the proposed result of the zoning change. During the afternoon hours when this location would be operating, school buses will pass by daily. Can you imagine a parent or grandparent trying to explain to a seven or eight year old what the business is they see and why only men are there? If you consider this, please deny the request. The neighborhood and surrounding home values will decrease if this zoning is approved. I believe there was a valid reason and good rationale for the current zoning. I don't know of any sane person who would think to themselves "I really want to live in that area because there is a 'Gentlemen's Club' on the corner. With the loud music all night long and the increase in traffic, I'll pay extra to live there!" My neighbors and I have worked hard to afford our homes. We do not want a decrease in our property values. If you consider this, please deny the request. I can't imagine that scantily -clad women mixed with men and alcohol would not result in an increase in alcohol related disturbances and perhaps other crimes. With the increase in gun - violence, it is a very real concern for those of us who live within 200 feet of the boundary of the property. If you consider this, please deny the request I have tried but I cannot think of one reason that the re -zoning would be a good idea. I ask you to earnestly consider these questions in your deliberations:" Would I want to live next-door to a 'Gentlemen's Club?" Members of the surrounding communities who live in and around the proposed location are petitioning against this. In addition, Arkansas State Senator, Linda Chesterfield, has met with many of her constituents regarding this issue and she fully supports them in this effort. Opening this type of establishment could have a negative lasting impact on the neighborhood and the families who reside there.
