A variance is requested from the
area regulations of Section 36-254
to permit construction of an
addition with a reduced rear yard
setback.
The proposed addition will match
the home's existing setback which
is architecturally and visually
more desirable.

The R-2 zoned property at #6 Hickory Creek Cove is occupied
by a one-story, brick and frame, single family residence.
The residence currently has a rear yard setback of 19.7
feet. The Code requires a rear yard setback of 25 feet.
The home was constructed at a time that the Planning
Director had authority, under Section 36-156(a)(2)(a), to
grant a variance from the setback provisions of up to
twenty-five percent of the Ordinance requirement. That
percentage has subsequently been reduced to ten percent.
The applicant desires to construct an addition onto the
house, maintaining the existing 19.7 foot rear yard setback.
Such a reduction now requires Board of Adjustment approval.
Staff believes the variance request to be reasonable. The
home backs up to a large common area and a lake. The
nearest home behind this house is approximately 300 feet
across the lake. Allowing the proposed variance will have

no impact on adjacent properties. The proposed variance is
for only 5+ feet of a small addition.
The proposed addition does extend into a portion of the lot
which is shown as "natural area." This is common on all of
the lots which front on to the private lake. Prior to a
building permit being issued, written approval must be
provided by the Hickory Creek Property Owners Association.
C. Staff Recommendation:
Staff recommends approval of the requested rear yard setback
variance subject to compliance with the following condition:
s Prior to issuance of a building permit, written approval
must be received from the Hickory Creek Property Owners
Association allowing the addition to extend into the 25
foot natural area. The letter is to be made a part -of
the record of this case and placed in the zoning case
file.

The applicant was present. There were no objectors present.
Staff presented the item and a recommendation of approval subject
to the following condition:
Prior to issuance of a building permit, written

Property Owners Association allowing the addition to
extend into the 25 foot natural area. The letter is
to be made a part of the record of this case and
placed in the zoning case file.
The applicant offered no additional comments.
The item was placed on the Consent Agenda and approved as
recommended by staff by a vote of 5 ayes, 0 noes and 0 absent.
