Variances are requested from the
building line provisions of Section
31-12 and the area regulations of
Section 36-254 to permit a carport
addition with reduced setbacks and
which is built across a platted
building line.
The proposed carport will maintain
the existing side yard setback.
The property has no covered
parking. The carport will still
set back 30 feet from the street.

The R-2 zoned property at 17 Belmont Drive is occupied by a
one-story, brick and frame single-family residence. The
residence has no carport or garage. It appears that the
carport may have been previously enclosed. The house has an
existing side yard setback of 5-5.2 feet on the west side.
The applicant proposes to construct a 20 foot by 22 foot
unenclosed carport addition onto the front of the residence.
The carport will maintain the existing side yard setback of
5.2 feet. The Code requires a side yard setback of 7 feet
for this lot. The carport will cross a platted 25 foot
building line and will have a front yard setback of 17.9
feet.
Staff believes the variance request to be reasonable. The
carport will be architecturally designed to match the house

and will be unenclosed on all sides, other than at the point
it adjoins the house. Maintaining the existing side yard
setback should have no impact on the adjacent property. The
carport will have a setback of 30 feet from the curb of the
street. This allows for adequate sight distance and should
not impact either traffic in the street or adjacent
properties.
Should the Board approve the building line variance, the
applicant will have to do a one -lot replat reflecting the
change in the building line. The applicant should review
the filing procedure with the Circuit Clerk's office to
determine if to replat requires a revised Bill of Assurance.
C. Staff Recommendation:
Staff recommends approval of the requested side yard, front
yard and building line variances subject to compliance with
the following conditions:
1. The carport is to remain open and unenclosed on all sides
other than at the point it adjoins the house.
2. A one -lot replat reflecting the change in the building
line as approved by the Board.

The applicant was present. There were no objectors present.
Staff presented the item and a recommendation of approval subject
to compliance with the conditions outlined in the staff
recommendation.
The applicant offered no additional comments.
The item was placed on the Consent Agenda and approved subject to
compliance with the following conditions:
1. The carport is to remain open and unenclosed on all sides
other than at the point it adjoins the house.
2. A one -lot replat reflecting the change in the building line
as approved by the Board.
The vote was 5 ayes, 0 noes and 0 absent.
