SYNOPSIS The request is to rezone 4.46 acres at the northeast corner of Arch
Street Pike and Dixon Road from unclassified to C-3 for future
commercial development.
FISCAL IMPACT None
RECOMMENDATION Planning staff recommends approval of the C-3 with a 75 foot OS area
adjacent to Old Castle Drive. The Planning Commission voted to
recommend approval of the C-3 and 75 foot OS buffer. The vote was
6 ayes, 2 nay and 3 absent. (The applicant amended the request to
include the OS area at the Planning Commission public hearing.)
CITIZEN The Planning Commission held a public hearing on August 6, 1998,
PARTICIPATION and there were 2 objectors present. Notice was mailed to an
individual in the England Acres Subdivision.
BACKGROUND The property is located approximately '/z mile outside the city limits,
but within the city's planning jurisdiction which has not been zoned.
As part of the Board's action authorizing a sewer tie -on for the site,
staff was directed to develop an extraterritorial zoning plan and zone
the 4.46 acres. Staff reviewed the land use plan for the area and
determined that a change from single family to commercial is
reasonable for the northeast corner of Arch Street Pike and Dixon
Road. Therefore, staff feels that a C-3 reclassification at the
intersection of a principal arterial, Arch Street Pike, and collector,
Dixon Road, is appropriate. Staff also supports including the OS area
to help buffer the England Acres Subdivision from the proposed
commercial development. The C-3 rezoning of the site is the final
step in the process to extend the city's zoning jurisdiction to the
property in question.

SYNOPSIS A resolution to express the intent to zone the northeast corner
of Arch Street Pike and Dixon Road.
FISCAL IMPACT None
RECOMMENDATION Planning staff recommends approval of the resolution. The
Planning Commission adopted the resolution by a vote of 8 ayes, 0
nays and 3 absent.
CITIZEN The Planning Commission held a public hearing on August 6,
PARTICIPATION 1998, and there were 2 objectors in attendance, representing the
England Acres Neighborhood Association. Notice was provided to
an individual in the England Acres Subdivision.
BACKGROUND The property in question, 4.46 acres, is located within the city's
planning jurisdiction, but in an area which the city has not zoned
and is only exercising subdivision controls. Recently, the property
owner requested permission to tie -on to an existing sewer main and
the Board authorized the tie -on by Resolution No. 10,291. The
resolution also expressed the city's intent to exercise zoning
jurisdiction in the area and directed staff to develop an
extraterritorial zoning plan and zone the 4.46 acres at the northeast
corner of Arch Street Pike and Dixon Road. The resolution is a
follow-up to the Board's action on the sewer tie -on.

A RESOLUTION OF THE LITTLE ROCK
PLANNING COMMISSION TO EXPRESS THE
INTENT TO ZONE THE NORTHEAST CORNER OF
ARCH STREET PIKE AND DIXON ROAD WITHIN
THE LITTLE ROCK PLANNING JURISDICTION.
WHEREAS, the City of Little Rock has authority to zone
property within 3 miles of the city limits under revised
Arkansas Statute 19-2829; and
WHEREAS, the City of Little Rock wishes to have orderly
and compatible growth within areas adjacent to the City
which could become part of the City of Little Rock; and
WHEREAS, the Board of Directors authorized the Little
Rock Wastewater Utility (B.O.D. Resolution No. 10,291) to
extend a sewer main for connection with an existing three
(3) inch sewer main on the property located at the northeast
corner of Arch Street Pike and Dixon Road; and
WHEREAS, the Board of Directors, by motion, directed
the Department of Planning and Development staff to develop
an extraterritorial plan for the area and to initiate the
process to zone the property to the appropriate district.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION
OF THE CITY OF LITTLE ROCK, ARKANSAS;
SECTION 1. That the City of Little Rock intends to
exercise its zoning jurisdiction and land use controls to
the northeast corner of Arch Street Pike and Dixon Road and
shown on the attached map described as Exhibit A.

13 WHEREAS, Little Rock, Ark_, Resolution No. 7,893 (February 2, 1988), requires the

16 WHEREAS, an applicant is requesting the extension of an existing 3 -inch force main

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
=4 Section 1. The Board of Directors approves the extension of a sewer main for
' 5 connection with an existing 3 -inch sewer main on property located outside the corporate limits of
the City at the northeast comer of Arch Street and Dixon Road, provided that no such extension
_ can be made until the owner executes binding preannexation agreements on behalf of the City,
complies with all zoning regulations the City would have for such a development, and complies
with any terms and conditions required by the Little Rock Wastewater Utility.
Section 2. The City intends to exercise e-xtraterritorial planning and zoning jurisdiction
I over this area, but if any requests for tie -ons occur before this jurisdiction is formally established,
no tie -on shall be permitted until the City has determined that the development otherwise
complies with any City planning and zoning requirements applicable to such developments.

DATE: JUNE 24,1998
Recently, an application was made to the Board of Directors requesting permission to
permit the owner of a 4.46 acre commercial development site at the Northeast corner of
Arch Street Pike and Dixon Road to tie -on to an existing 3 -inch force main (please see
attached. plat). The ' small force main was extended many years ago prior to the
implementation of the Board's current policy. The Board has subsequently granted the
sewer extension and passed a motion directing the staff to develop an extraterritorial
zoning plan for the site.
After careful review, _the City Manager's Office recommends that the City's zoning
jurisdiction be permitted to extend only to the 4.46 acre commercial development site
referred to in the attached plat. Furthermore, it is our understanding that the owner does
not oppose placing zoning controls on the proposed development site.
The next course of action requires the Planning Commission to act on a resolution
expressing the City's intent to exercise its zoning jurisdiction. Additionally, the
Commission will be required to act on a major plan amendment for the property and its
immediate vicinity. Finally, the Commission will then rezone to the appropriate zoning
district.
Concomitantly, the Board of Directors will follow the same steps.
The proposal should have no significant fiscal impact because no municipal services
would be required to complete the project. If you have any questions, please call.

SUBJECT: England Acres Extraterritorial Zoning Issue (Arch Street Pike and Dixon Road)
DATE: June 18, 1998
Following are some points to consider when putting together the memorandum to the Board.
Request was made to extend sewer to a proposed commercial development at the Northeast
corner of Arch Street Pike and Dixon Road. The Board of Directors granted the sewer
extension and passed a motion directing staff to develop an extraterritorial zoning plan for the
area.
Staff has reviewed the issue with City Manager's office and it is Cy's recommendation that the
City's zoning jurisdiction only be extended to the property in question, 4.46 acres, at this time.
It is our understanding that the owner does not oppose the city placing zoning controls on the
site.

The applicant is requesting that the Board allow a sewer tie- '
on to an existing 3 in force main (see attached map). The
applicant is proposing to construct two commercial buildings
(strip shopping center) on the 4.46± acre site (see attached
letters).
FISCAL IMPACT
The proposal should have no significant fiscal impact in that no
municipal services would be required.
RECOMMENDATION
Denial of the resolution allowing a sewer tie -on outside the city
limits.
CITIZEN
No public review of this request has been necessary. The
PARTICIPATION
proposal has been reviewed by the staff and the Little Rock
Wastewater.
BACKGROUND
Sewer service is available from an existing force main located
outside of the city limits. The Board's policy is not to extend
sewer service outside the corporate limits without its prior
approval. The sma 1 force main was extended many years ago
prior to implementation of the Board's current policy. The staff
has consistency discouraged the extension of any sewer service
to property that did not annex first. This property is not
adjacent to the city limits and, therefore, cannot annex. Sewer
service, for the most part, is contained entirely within the city
limits. Finally, extension of sewer service outside the corporate
limits sets a dangerous precedent that could result in significant
urbanization adjacent to but outside the city's corporate limits.

RESOLUTION NO.
A RESOLUTION OF THE CITY OF LITTLE ROCK TO
EXPRESS THE INTENT TO ZONE THE NORTHEAST CORNER
OF ARCH STREET PIKE AND DIXON ROAD WITHIN THE
LITTLE ROCK PLANNING JURISDICTION.
WHEREAS, the City of Little Rock has authority to zone
property within 3 miles of the city limits under revised Arkansas
Statute 19-2829; and
WHEREAS, the City of Little Rock wishes to have orderly and
compatible growth within areas adjacent to the City which could
become part of the City of Little Rock; and
WHEREAS, the Board of Directors authorized the Little Rock
Wastewater Utility (B.O.D. Resolution No. 10,291) to extend a
sewer main for connection with an existing sewer main on the
property located at the northeast corner of Arch Street Pike and
Dixon Road; and
WHEREAS, the Board of Directors, by motion, directed the
Department of Planning and Development staff to develop an
extraterritorial plan for the area and to initiate the process to
zone the property to the appropriate district; and
WHEREAS, the Little Rock Planning Commission, after
conducting a public hearing, adopted a resolution expressing the
intent to extend zoning to the property and recommended approval
of C-3 and OS zoning for the northeast corner of Arch Street Pike
and Dixon Road.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF LITTLE
ROCK BOARD OF DIRECTORS:
SECTION 1. That the City of Little Rock intends to exercise
its zoning jurisdiction and land use controls to the northeast
corner of Arch Street Pike and Dixon Road as shown on the
attached map and described as Exhibit A.
