Staff Analysis: Z-6516 George Gleason 126 Hickory Creek Circle Long Legal R-2 Variances are requested from the building height provisions of Section 36-254 and the fence height provisions of Section 36-516. The building height is necessary to accommodate an indoor tennis court. The increased fence height is necessary for security purposes. Single Family Single Family with ancillary uses; tennis court, pavilion, guesthouse and gardens The applicant currently has a large home on two lots within the Hickory Creek Subdivision. He has now acquired unplatted property totaling approximately 11.68 acres directly behind and adjacent to the Hickory Creek home. The applicant proposes to develop the entire property into a true "estate" with all of the amenities associated with a large estate. No changes will be made to the Hickory Creek home, other than having an access point created in the back of the property to connect the Hickory Creek property to the adjacent 11.68± acre tract. The 11.68± acre tract will be developed with uses including a single family residence, a pavilion, a maintenance building, a water garden and nature trail and a multi purpose building. The multi purpose building will contain an indoor tennis court, exercise rooms, restrooms and facilities for entertaining guests. The multi purpose building will have an overall height of 50 feet. The code limits the height of buildings in the R-2 June 29, 1998 Item No.: 11 Cont. district to 35 feet. The property will be enclosed by an 8 foot tall wrought iron fence with brick columns. The fence will run along Charleston Lane and Rahling Road at a point 15 feet behind the property line. The code limits the height of fences erected within required setbacks adjacent to streets to 4 feet. Otherwise, fences in residential zones are limited to 6 feet in height. Staff believes the variance requests to be reasonable. The proposed 15 foot variance for the height of the indoor tennis court should have no effect on adjacent properties. The building is located near the center of the tract and is well set back from all property lines. The site is heavily wooded and much of the property will remain in its natural state. The mature trees on the site will provide a visual screen. The proposed 8 foot tall fence is not out of character with other fences in the area. The Hickory Creek Subdivision is enclosed by fencing and walls up to 10 feet in height. The fence along Charleston Lane and Rahling Road will be set back 15 feet behind the property line, 25± feet behind the curb. It is important to note that although this is a true estate and, for all intents and purposes, a single development, it does consist of two separate single family home sites. The single family home comprised of the two Hickory Creek lots is one property. The unplatted 11.68± tract is a second, separate home site containing a single family home and the previously discussed ancillary uses. As long as these remain two, separate and distinct properties, there is no issue. Should the applicant desire to replat the entirety of the site into one lot, it does create a problem because there would then be two dwellings on one lot. Such an arrangement can only be approved by the Planning Commission. C. Staff Recommendation: Staff recommends approval of the requested building height and fence height variances. HOARD OF ADJUSTMENT: (JUNE 29, 1998) The applicant was present. There were no objectors present. Staff presented the item and a recommendation of approval. The applicant offered no additional comments. The item was placed on the Consent Agenda and approved by a vote of 5 ayes, 0 noes and 0 absent. 2
