Public works Issues: Z-6511 James and Caren Crossland 4305 Longtree Cove Lot 44, Longlea Manor R-2 A variance is requested from the area regulations of Section 36-254 to permit construction of a deck addition with a reduced rear yard setback. Applicant's Statement: The new addition plans have been drawn to allow us to have more deck space while providing a safer environment for our children. Our current deck is 12 feet off of the ground on one side due to a slope in the backyard. The new plans show the deck addition having two graduating levels to bring it within 3 feet of the sloping yard. The new levels will have wide platform type stairs rather than the current standard staircase, this should also be safer for the children. In order for us to add any additional space without endangering the safety of loved ones we must encroach the variance areas slightly. Staff Analysis: The R-2 zoned property located at 4305 Longtree Cove is currently occupied by a two-story, brick and frame, single June 29, 1998 Item No.: 6 (Cont. family residence. A wood deck is located on the rear side of the house. Due to the slope of the lot, the existing deck is 12+ feet above grade. The applicants propose to modify the deck by adding two graduating levels to bring it down to within 3 feet of grade. The graduating levels and wide, platform stairs will provide for safer access to the yard for the applicants' children. The deck addition will come to a point 13 feet from the rear property line. The code requires a rear yard setback of 25 feet for this lot. Staff believes the variance request to be reasonable. The deck addition will be uncovered and unenclosed other than by railing. This relatively minor deck intrusion should have no impact on adjacent properties. C. Staff Recommendation: Staff recommends approval of the requested rear yard setback variance for the deck addition subject to compliance with the following conditions: 1. The deck is to remain uncovered and unenclosed other than by required railing. 2. Compliance with Public Works Comments BOARD OF ADJUSTMENT: (JUNE 29, 1998) The applicant was present. There were no objectors present. Staff presented the item and a recommendation of approval subject to compliance with the conditions outlined above. The applicant offered no additional comments. The item was placed on the Consent Agenda and approved as recommended by staff. The vote was 5 ayes, 0 noes and 0 absent. 2
