Staff Analysis: Z-6510 Residential Developers, L.L.C./ Cecily Skarda 105 Trelon Way Lot 113, Block 48, Chenal Valley R-2 Variances are requested from the building line provisions of Section 31-12 and the area regulations of Section 36-254 to permit construction of stairs which have a reduced front yard setback and which cross a platted building line. The excessive slope of the lot caused the foundation to be higher off the ground than anticipated. Because of this height, the improvement will require a substantial staircase leading up to the front door. Single Family home, under construction Single Family The applicants are currently constructing a new single family home on the R-2 zoned property located at 105 Trelon Way. The property is in a newly developing phase of Chenal Valley located between the base of Shinnal Mountain and Highway 10. Once the home was under construction, it became apparent that, due to the slope of the lot, the finished floor of the home would be 8+ feet above grade. The front wall of the house is at the building line and any stairs will have to be built across that line. The applicant proposes to construct stairs which will extend 10 feet June 29, 1998 Item No.: 5 (Cont. across the 25 foot building line. The stairs will have a front yard setback of 15 feet. The Code requires a front yard setback of 25 feet for this lot. Staff believes the variance request to be reasonable. The applicant has presented a true hardship in that, without a variance, access cannot be gained to the front door. The variance request is for only the stairs and hand rails. There will be no roof or covering over the stairs. The stairs will sit back from the curb of Trelon Way 21-22 feet and allowing the variance should not impact any adjacent properties. The visual impact of the stairs can be somewhat mitigated by additional filling to raise the grade of the lot and by plantings of shrubbery along the base of the stairs. Should the Board approve the building line variance, the applicant will have to do a one -lot replat, reflecting the change in the building line. The applicant should review the filing procedure with the Circuit Clerk to determine if the replat requires a revised Bill of Assurance. C. Staff Recommendation: Staff recommends approval of the requested building line and front yard setback variances for the stairs -subject to compliance with the following conditions: 1. A one -lot replat reflecting the change in the building line as approved by the Board. 2. The stairs are to remain uncovered, no portion of the roof line may extend across the building line. 3. Shrubbery should be planted along the base of the stairs to help mitigate the visual impact. BOARD Of ADJUSTMENT: (JUNE 29, 1998) The applicant was present. There were no objectors present. Staff presented the item and a recommendation of approval subject to compliance with the conditions outlined above. The applicant offered no additional comments. The item was placed on the Consent Agenda and approved as recommended by staff. The vote was 5 ayes, 0 noes and 0 absent. 2
