Applicant's Statement: I am requesting a variance of the 25 foot rear building set back for the home under construction at 39 Village Grove (lot 19 block 6 of the Villages of Wellington). The property is a pie shaped parcel that adjoins a large common area in the back of the property. Due to the narrow frontage, beginning at only 45 feet, the house with an attached garage had to be situated approximately 55 feet from the front property line. Also the Villages of Wellington development covenants and building restrictions strictly enforce that boats, trailers, etc. must be stored within enclosed garages. Therefore, our garage is designed with extra depth to accommodate this storage. A request for a variance of the rear of property setback is therefore being made. As presently designed, the Northwest corner of the garage will be 15.5 feet from the property line. The garage angles sharply so that the proper clearance will be met within approximately 12 feet. The rear of the property adjoins a large commons area so the building will not encroach on any other homeowners. All other building June 29, 1998 Item No.: 4 Cont. Vacant lot Single Family The applicant proposes to construct a new single family residence on the R-2 zoned lot located at 39 Village Grove Road. The property is located within the new Villages of Wellington Subdivision. The proposed new home is to have a rear yard setback of 15.5 feet. The code requires a rear yard setback of 25 feet for this lot. Staff believes the variance request to be reasonable. The lot is "pie -shaped", being only 45 feet wide -.at the front. The applicant has pulled the home away from the front property line and angled it slightly in order to maintain side setbacks and still obtain the desired square footage for the house. A portion of the garage extends into the required rear yard. Staff believes this corner intrusion should have no effect on adjoining properties. A tract of common property "greenspace" is located behind the property. This green space varies in depth from 50± feet to 200± feet, providing the appearance of a much greater rear yard. The Subdivision's Bill of Assurance prohibits outside storage of boats, trailers, etc.... In order to accommodate this storage, the applicant has proposed a garage which is deeper than that typically found on most residences. C. Staff Recommendation: Staff recommends approval of the requested rear yard setback variance. BOARD OF ADJUSTMENT: (JUNE 29, 1998) The applicant was present. There were no objectors present. Staff presented the item and a recommendation of approval. The applicant offered no additional comments. The item was placed on the Consent Agenda and approved by a vote of 5 ayes, 0 noes and 0 absent. K
