Public Works Issues: Z -6500-A Moco Investments, LP 1020 S. Taylor Street Lots 1R and 3R, John B. May Addition I-2 and C-3 Variances are requested from the area regulations of Sections 36-301 and 36-320 and the building line provisions of Section 31-12 to permit construction of a new building with reduced setbacks. Moving the proposed building is necessary to provide adequate parking and loading space. Antique auction house and warehouse Antique auction/showroom and warehouse Property frontage needs to have sidewalks and ramps brought up to current ADA Standards. Repair and extend any damaged or missing curb and gutter on all frontage with planned development. Provide turn -around at the end of 11`h Street and dedicate additional right-of-way. B. Staff Analysis: Capitol City Auction is located on the I-2 and C-3 zoned property at 1020 S. Taylor. The property consists of a portion of the block bounded by West 10`h, West 11`h, S. Taylor and the now closed S. Filmore Streets. Capitol City proposes to construct a new 7,500 square foot building on the western side of the block to house additional warehouse and showroom space. A platted, 15 foot building line extends along the western perimeter of the block. The new building is proposed to cross this platted building line and is to have a setback of 10 feet. Both the C-3 and I-2 Districts require a rear yard of 25 feet. That requirement December 21, 1998 Item No.: 2 (Cont had been superceded by the platting of the 15 foot building line. The additional space is needed to allow for adequate clearance for parking along the east side of the proposed building and to provide for truck loading at the southeast corner of the building. Staff believes the variance request to be reasonable. The property adjacent to the west is occupied by a large church. The back side of the church faces the applicant's property. A driveway and parking lot separate the church building from the applicant's proposed new building. Allowing this 5 foot variance should not impact the church site. A 10 foot utility/drainage easement currently bisects the proposed new building. The applicant has filed for abandonment of this easement. The abandonment request will be heard by the Board of Directors in early February 1999. The utility companies and Public Works Department have stated their approval of the easement abandonment. Should the Board approve the building line variance, the applicant will have to do a one lot replat reflecting the change in the building line. The applicant should review the filing procedure with the Circuit Clerk's office to determine if the replat requires a revised Bill of Assurance. C. Staff Recommendation: Staff recommends approval of the requested building line and setback variances subject to compliance with the following conditions: 1. A one lot replat reflecting the change in the building line as approved by the Board. 2. Compliance with Public Works Comments 3. Compliance with the City's Landscape and Buffer Ordinances 4. Abandonment of the easement which bisects the proposed new building. BOARD OF ADJUSTMENT: (DECEMBER 21, 1998) The applicant was present. There were no objectors present. Staff presented the item and a recommendation of approval subject to compliance with the conditions noted in the "Staff Recommendation" above.
