Filmore Lot 3 and south 20 feet of Lot 2, Block 25, Park View Addition R-2 Variances are requested from the area regulations of Section 36-254 to permit construction of a new house with reduced side yard setbacks. The reduced setbacks will allow the architect to attach the garage to the side of the residence. Without the variance, the garage will have to be detached and placed in the rear yard. This would be architecturally inconsistent with the surrounding neighborhood. Vacant lot Single Family The R-2 zoned property located at 2519 N. Filmore is currently vacant. The applicant proposes to construct a new, two-story residence on the property. The new residence will have side yard setbacks of 6 feet. Section 36-254 requires side yards of 7 feet for this lot. Staff believes the variance requests to be reasonable. The applicant desires to construct the home with a front -loading garage which would be architecturally compatible with the neighborhood. This could be accomplished without a variance by reducing the width of the house by 2 feet, however staff feels that the minor encroachments proposed should have no impact on adjacent properties. The lots in the Heights are May 18, 1998 Item No.: 9 (Cont. typically 50 feet wide and side yard setbacks of 5 feet are common in the area. The proposed 6 foot side yards are not out of character for the area. C. Staff Recommendation: Staff recommends approval of the requested variances to allow side yard setbacks of 6 feet. HOARD OF ADJUSTMENT: (MAY 18, 1998) The applicant's representative was present. There were no objectors present. Staff presented the item and a recommendation of approval. The applicant's representative offered no additional comments. The item was placed on the Consent Agenda and approved by a vote of 5 ayes, 0 noes and 0 absent. 2
