Justification: Applicant's Statement: Said house was built some 30 years ago. At that time, the house was built too close to the east side of the property. This property was inspected and passed by the City of Little Rock Inspection division. We would like to enclose the existing carport, to make a sitting room, with its own entrance. We will not extend the roof line or the concrete slab which already exists on the property. Mr. Larson has lived at this address for 5 years and has a letter from his neighbor to the east saying he is in favor totally of the project. Staff Analysis: The R-2 zoned property at 10820 Bainridge Drive is occupied by a two-story, brick and frame, single-family residence. The home has an 18' X 22.6' carport attached on the east side. The carport has an existing side yard setback of 51. Section 36-254 requires a side yard setback of 7.6' for this lot. The house, including the carport, was built approximately 30 years ago. Staff is uncertain how the structure was built with the reduced side yard but, by virtue of the structure's age, considers the structure nonconforming. The applicant proposes to enclose the carport to create expanded living space. Section 36-154(a) prohibits any increase in the degree of nonconformity of any structure which has been declared nonconforming. Staff determined that enclosing the open carport and expanding the living area into the carport space would be an increase in the degree of nonconformity. The applicant is requesting a variance to recognize the existing 5' setback and to allow for the enclosure of the carport. Staff is supportive of the requested variance. There will be no change in the existing carport slab or roof line. with the 5 foot setback, there is adequate separation between this structure and the home on the adjacent lot. The owner of the adjacent property has submitted a letter in support of the applicant's proposal. The structure has a front yard setback nearly double that required in the R-2 district. Allowing the enclosure of the existing carport should have no impact on adjacent properties. C. Staff Recommendation: Staff recommends approval variance to recognize the applicant to enclose the BOARD OF ADJUSTMENT: of the requested side yard setback existing setback and to allow the carport. (MAY 18, 1998) The applicant was present. There were no objectors present. Staff presented the item and a recommendation of approval. The applicant offered no additional comments. The item was placed on the Consent Agenda and approved by a vote of 5 ayes, 0 noes and 0 absent. 2
