A variance is requested from the
area regulations of Section 36-255
to permit a carport addition with
a reduced side yard setback of
2 feet.
APnlicant's Statement: This
carport was built by myself and a
friend of mine during our Christmas
vacation from school. I spent my
entire vacation working and made
major improvements to the house.
This carport has 2X41s and 2X61s
and has a very strong structural
built to it. I immediately stopped
all work on it, till I obtained a
variance. The carport just needs
finishing touches to be completed.
I previously rented a house for a
year at 5323 Maryland Avenue. I
had a couple of break-ins there.
Before I purchased this house on
5017 Maryland Avenue, I spoke with
the neighbors. I was informed that
the lady's house next door to my
house had been broken into 4 times
in the past couple of months and
the house next door had also been
broken into recently. But, I could
afford this house and felt that I
could make a positive difference in
this neighborhood. I put up motion
lights around the whole house, an
alarm system, put up privacy wooden
fencing around the house and I have
two dogs. This was a mess and
trashed when I purchased it and all
my neighbors have noticed the
improvements I did to this house.

I have a 1966 Pontiac GTO that took
me 3 years to restore. This car
was broken into 2 times previously.
And with the break-ins around, I
felt that a carport would keep this
car safe from the weather and
future break-ins. Myself and my
family intend to live here for a
while and felt a carport would
definitely be useful, in many
various ways. I spend a lot of
time and money to build this
carport and it makes the house look
very nice. I can move the carport
back 2 feet which would make a 2
feet setback from the property
line. I am also going to install
guttering so as to avoid running
water in that area. I will move
the complete structure 2 feet back
from the fence (property line).

A. Public Works Issues:

B. Staff Analysis:
The R-3 zoned property at 5017 Maryland Avenue is occupied
by a small, single family residential structure. The
occupant of the home has recently constructed a carport
addition onto the east side of the house. The addition
resulted in a side yard setback of 0 feet. The Code
requires a side yard setback of 5 feet for this lot. On
July 27, 1998, the Board of Adjustment denied a variance to
allow the carport to remain with that 0 foot setback. Staff
had recommended a minimum side yard setback of 18 inches to
allow for guttering, adequate separation between structures
and to allow for work on the structure without having to
enter the adjacent property. There was no neighborhood
opposition.
The applicant has now determined that the carport can be
modified so as to maintain a side yard setback of 2 feet.
The reason this is now possible is because a gas meter which
was located on the east side of the house has been

relocated. Moving the gas meter resulted in more room to
park a vehicle beside the house.
Staff is supportive of the requested side yard variance. As
was noted in the July 1998 action, the 2 foot side yard will
allow for guttering, adequate separation between this
structure and the home on the adjacent lot and will allow
for maintenance of this structure without having to intrude
on the adjacent property.
C. Staff Recommendation:
Staff recommends approval of the requested side yard setback
variance subject to compliance with the following
conditions:
1. The carport is to remain open and unenclosed on all
sides other than at the point it adjoins the house.
2. Guttering is to be installed on the carport to prevent
water runoff onto the adjacent property.
3. The closest edge of the carport (not counting guttering)
is to be no less than 2 feet from the east side property
line.
BOARD OF ADJUSTMENT: (OCTOBER 26, 1998)
The applicant was not present. There were no objectors present.
Staff presented the item and a recommendation of approval subject
to compliance with the following conditions:
1. The carport is to remain open and unenclosed on all sides
other than at the point it adjoins the house.
2. Guttering is to be installed on the carport to prevent water
runoff onto the adjacent property.
3. The closest edge of the carport (not counting guttering is
to be no less than two (2) feet from the east side property
line.
There were no additional comments.
The item was placed on the Consent Agenda and approved as
recommended by staff. The vote was 3 ayes, 0 noes, 1 absent
and 1 open position.
