Variance Requested: Variances are requested from the
area regulations of Section 36-254
and the building line provisions of
Section 31-12.
Justification: Applicant's Statement: We are
requesting that the front setback
requirement on residential Lot 10,
Block 11 in Phase IX of Cherry
Creek, an addition to the City of
Little Rock be reduced from 25 feet
to 20 feet.
Although this lot was properly
platted and legally offered for
sale, the rear 65 feet of the lot
is impacted by a drainage channel
that we widened at the request of
Public Works.
The widening of the drainage
channel and the filling of this lot
has reduced the flood hazard as
well as increased public safety
during flood events. However, as a
result of the drainage widening,
the building site and rear yard has
been greatly reduced.
The front setback variance will
allow our builder to position the
home further away from the drainage
channel and also provide an
adequate backyard.

Staff Report:
A. Public Works Issues:
No issues.
B. Staff Analysis:
The R-2 zoned lot at 1904 Brookford Drive is a vacant
residential lot. A large portion of the rear of the lot is
encumbered with a drainage and utility easement. The
easement width varies from 42 feet on the north to 65 feet
on the south. A platted 25 foot building line is located on
the front of the lot. The easement, combined with the
building line, reduces the buildable area of the lot. The
applicant is requesting a variance to allow a front yard
setback of 20 feet.
At this point staff is not supportive of the variance
request. No specific house plan has been submitted which
might demonstrate some hardship, requiring the variance.
The lot adjacent to the south is even more greatly impacted
by the drainage easement. The easement is up to 91+ feet
wide on this adjacent lot. An 1,887 square foot house is
now under construction on that lot. This house is being
built within the remaining buildable area, without any
variances.
Staff believes no evidence of a hardship has been presented
to support a variance. As evidenced by the construction on
the adjacent lot, ample buildable area appears to be
available.
C. Staff Recommendation:
Staff recommends denial of the requested variance.

The applicant was not present. There were no objectors present.
Staff informed the Board that the applicant had requested
withdrawal of the item.
The item was placed on the Consent Agenda and approved for
withdrawal by a vote of 4 ayes, 0 noes and 1 absent.
