The Hillcrest Residents Association (HRA) Board met on Monday night. The board took stands on two issues of immediate concern to the city. First we did discuss Dean Kumpuris' project and proposed parking lot. The HRA voted to oppose the suggested parking lot primarily on the grounds it is a net loss of housing within the neighborhood. The other issue discussed in relation to this was business encroachment into the neighborhood. Should you need further confirmation of this vote, let me know The other issue that was taken up by the NRA Board was the request for the extension of hours and increase in seating capacity from Poncho Villa's Restaurant. The HRA Board voted unanimously to oppose both the extension of hours and the increase in seating capacity. The lack of parking, traffic, noise, the smell around the dumpster, and lack of security\screening for the dumpster were all given as indicators for our decision. The HRA would also like to examine the current PCD for the property and ask that the city enforce the current restrictions on the property immediately. Two items: First: Dean Kumpuris is coming before the planning commission tonight with a proposal for expanding the parking lot at the corner of Lee and University. After polling our HRA board, we would like the planning commission to delay the approval of the variance until we can review the plans. I have seen a letter from Dean to Mrs. Wahlgreen about the property, but I and the HRA have not seen a detailed plan. If it goes before the board as is, the HRA would oppose it due to the lack of information and the loss of a residential property in our neighborhood. Second: The old Percito's restaurant is now a problem again. I had thought the stipulation was the restaurant could not be open past 6:30? 1 have seen posted on the door hours until 9:00 pm. the noise, parking, and garbage issues that were a problem before are resurfacing now, I have been contacted by residents living close to the property (not the same ones as before ... they have moved) about the property. The restaurant, Pancho's Villa, is operating out of a leased building at 600 North Tyler -- less than a half block from my property. The tenants and the property owner previously petitioned the City of Little Rock for a change in operating hours, and an increase in their seating capacity. Both requests were denied. They are appealing, however, and the issue will come before the board at next Tuesday's meeting. As a resident of North Tyler, and a person who is directly affected by the operations of such an establishment in my neighborhood, I would like to ask that you deny their request for the following reasons: 1. Parking problems: It is my understanding that, based on the size of the restaurant, the facility is supposed to have 15 off-street parking spaces. Because no off-street parking exists, the patrons park on the street outside the residents' homes. While I have a driveway for my own vehicles, this presents a hardship for my neighbors who do not, and for my guests who need parking when they come to visit me. 2. Restaurant's failure to adhere to previous Board rulings: Even though their initial request to extend their hours was denied by the City, the restaurant has continued to remain open long past the proscribed 6:30 pm closing time. This adds to the traffic congestion and parking problems for residents arriving home from work in the evenings. 3. Improper treatment of garbage: The restaurant has failed to put a fence around the dumpster at the back of their property. While the sight of a full dumpster is visually unappealing, the smell of the garbage is worse. 4. Increase in pest problems: My house is treated every quarter for all types of pests, and my most recent exterminator visit revealed that there was rat activity under my house. Two of my neighbors, who have never previously had problems of this type, have told me that they also have found evidence of rats and mice at their property. Mayor Daily, this is a residential neighborhood, and I believe the requests of the property owner and tenants are inappropriate for the overall "personality" of the North Tyler area. Please oppose the extension of the property's operating hours, and their request to increase the number of seats, and ask that they comply with current zoning regulations. Tyler. I have been approached by both side of the issue asking me to write a letter stating my position on the matter. In the nearly ten years I have been in the neighborhood I have seen six businesses at this location. I know any decision you make will not make evervone hannv_ My personal feeling is this piece of property needs more parking if it is to a successful business. Any business that has a large volume of traffic is bound to cause problems at this location unless the parking issue is addressed. We would not be opposed to patrons of "Poncho Villa" parking in our church's parking lot, but we are a block away from the business and in inclement weather I do not feel this will be a solution. For the neighborhood as a whole I do not feel that this restaurant causes a great deal of problems. Ms Johnson has been willing to work with some of the issues and concerns brought by many neighbors. However for the neighbors who live next to or across the street from this location there has been cause for frustration. Some have complained about parking up and down Woodlawn and in front of their homes and yards. When they come home from work they have difficulty finding a place to park. I have always felt that if I wotild not want something happening to me then I should support the rights of others. Tyler re/ changes in seating capacity and hours of operation. We live on Woodlawn at the opposite end of the same block on which this restaurant is located, and were one of those opposed when Cafe Precito requested the same changes in regard to hours of operation. Our opposition then concerned what appeared to be after hours private parties that included liquor, even though they did not have a liquor licence, traffic problems which included parking and reckless inattention to driving, noise, and the overall attitude of the cafe owner in regard to the neighbors. In talking with Mrs. Johnson, she has a much friendlier attitude toward the neighborhood and seems to want to work with us not against us. She has definitely made the place look better with the owner having the building painted for her and Mrs. Johnson doing some landscaping with plants and flowers. Though with the current construction going on on Tyler Street the latter is not easily seen at present. Her customers are a total different type of clientele. The only problem that still exist for us is the parking situation. However, this location is not the only place where there are problems; many residents and guests park on the streets, making it difficult, at times, for two cars to pass. Mrs. Johnson's peak business appears to be at lunch time [11a -Ip], during the afternoon there is no more congestion than would be normal for the area. There does not seem to be as much traffic congestion at night, I suppose because everyone is not trying to get in and out within a short period of time. We have gone to dinner on several nights and have been there when she was quite busy with most of the tables occupied and the number of cars parked outside did not appear to be as many as are there during the lunch time. I am not opposed to the changes being requested but do wish the parking could be solved. Does our city zoning not allow for the paving of the backyard area at this location that could then be used for off-street parking. Though it is a different situation all together, the recent remodeling at Fair Park School has done this with a portion of their playground area and it took quite a few cars off the street. 4 Jerrald Douglass. I have lived here since July, 1991 and have owned my home since May, 1994. Like with many neighbors, I have made considerable improvements to my home, including an 800 square feet addition. Once again a restaurant has opened at Mr. Brashears' property and is operating outside of the hours required by the zoning at 600 N. Tyler. It is hard to understand how this could happen since Mar. Brashears was notified by the City of Little Rock, Department of Planning and Development in a letter dated April 4a`, 2003, a copy of which is attached, that states that the hours of operation for this facility will be 10:30 AM to 6:30 PM. On July 15th 2003, the City directors denied the request of Cafe Percitos to stay open until 9:00 PM on a six-month trial basis, as stated in the attached newspaper article. I obtained both the letter and the newspaper article from the City of Little Rock's file on Mr. Brashears' property. Now Mr. Brashears has leased his property to Poncho's Villa Mexican American Restaurant (Poncho's Villa). Poncho's Villa's hours are posted at the facility and they are opened until 9:00 PM, Monday — Saturday. Why Mr. Brashears would lease to someone that was going to remain open after 6:30 PM, and why Poncho's would move into our neighborhood and immediately operate in violation of the zoning requirements is difficult for me to understand. As a resident of our City and of this neighborhood, I am entitled to expect that any business that moves into the neighborhood will comply with the established zoning. I also expect that Mr. Brashears would require his tenants to comply with the zoning laws for his property. It is my understanding that Poncho's Villa must apply to the City to extend the hours at 600 N. Tyler to 9:00 PM. I oppose the change in hours of operation at 600 N. Tyler, and I want Poncho's Villa to be required immediately to comply with all existing zoning requirements, including closing by 6:30 PM. -1- From the day that Poncho's opened, Friday, August 26th, the restaurant has consistently been in violation of the following existing zoning requirements: • Violation: The restaurant stays open until 9:00 PM Monday — Saturday when the hours of operation are supposed to be 10:30 AM to 6:30 PM, Monday -Saturday; • Violation: The restaurant actual seating capacity greatly exceeds the number of seats it is allowed; • Violation: There is no screening around the dumpster; • Violation: Vehicles have been routinely parked in the yard; ■ Possible Violation: There are temporary signs in the yard, but the City has not verified to me whether the restaurant has a permit for these signs. These signs were removed a few days ago. There are many other problems with this restaurant being located in a residential area of Hillcrest: a There is no off-street parking for this restaurant. I have observed over 20 cars parked on the street associated with the restaurant on more than one occasion. • Excessive amounts of traffic and congestion of vehicles associated with the restaurant regularly occur on N. Tyler and N. Woodlawn, especially during the lunch and dinner hours. The quiet residential character of our neighborhood has been totally changed due to the excessive traffic and congestion of vehicles. Also, this traffic poses a safety concern for people who live in the area and for the children at Fair Park `Early Childhood Center," which is across the street from the restaurant. Children at Holy Souls Catholic School, only a few blocks away, could be jeopardized by this traffic, too. a There are no sidewalks or a parking lot on the restaurant property and, therefore, no safe place for customers to walk from their vehicle to the restaurant in the midst of the traffic/congestion created by the restaurant. • I have frequently observed people associated with the restaurant park illegally on the street and restaurant customers leave their cars running while going inside to pick-up their "to go" orders; this jeopardizes pedestrians and people driving to and from their homes, etc. • For residents who live near the restaurant and whose primary parking is on the street, leaving their homes during the restaurant hours, means they probably will not be able to park near their homes when they get back, which has happen to me on several occasions. Also, their family and friends have a difficult time visiting the residents because there is no parking available. -2- • On Thursdays and Fridays at a minimum, I have experienced the smell of grease outside even several houses from the restaurant. o On at least two occasions, I could smell grease in my home from the restaurant from 1:30 PM to 10:00 PM. • The garbage dumpster has a strong offensive odor that you can smell as you walk down N. Woodlawn Street. • I have watched restaurant customers put their trash in the back of my pick-up truck parked next to my home. Extending the hours at this facility will force residents to endure most of these problems at night as well as during the day. This will negatively affect both my and my neighbors' quality of life and our property values. Please do not allow the extension of the operating hours of Poncho's Villa and please require the restaurant to comply immediately with all current zoning requirements.
