A variance is requested from the
area regulations of Section 36-254.
Applicant's Statement: In order to
build the home we desire we
respectively request a variance of
the twenty-five foot rear building
setback line to the ten foot
easement line. This variance will
allow us to place our garage in the
rear of the property and attach it
to a rear porch we have designed.
Without a variance we will have to
modify our plan to allow for a
minimum six foot spacing between
these structures which would 1)
cause a substantial downsizing of
the porch or 2) necessitate an
elimination or downsizing of the
front porch or 3) require a front
loading style garage or 4) cause a
radical change in our entire plan.
These changes would in our opinion
decrease the "friendly" aspects of
our plan and minimize the positive
attributes of this lot and its
location.
This lot is bordered on the rear
and left by substantial common
property. This fact minimizes or
eliminates any impact of this
variance on the surrounding
property.

A. Public Works Issues:

B. Staff Analysis:
The property at 24 Village Grove Road is an undeveloped lot
in the new Village of Wellington Subdivision. A few new
homes are being built in the area but nothing is being built
as yet directly near this site. The applicant proposes to
construct a new 1 1/2 story single family residence on the
site. A portion of the garage and deck on the rear of the
house will have a reduced rear yard setback of 10 feet. The
code requires a rear yard setback of 25 feet for this R-2
zoned property. One corner of the proposed deck will have a
side yard setback of 3 feet. An 8 foot side yard is
required for this lot.
Staff believes the variance requests to be reasonable. Due
to the angle of the structure in relationship to the side
and rear property lines, only a corner of the deck extends
into the required side yard and only a portion of the
structure extends into the required rear yard. The deck
will be uncovered and unenclosed. An area of undeveloped
common property or "green space" is located behind and to
the south of the property. No homes will be built in this
area so no one should be impacted by the proposed reduction
in the side and rear yard setbacks. This "green space" area
is over 100 feet deep on both the rear and side of the
subject site, providing more than adequate separation
between the applicant's home and the nearest home site.
C. Staff Recommendation:
Staff recommends approval of the requested side and rear
yard setback variances subject to the deck remaining open
and unenclosed.

Staff presented the item and a recommendation of approval subject
to the deck remaining open and unenclosed.
