A variance is requested from the
area regulations of Section 36-254
to permit an addition with a side
yard setback of 5 feet.
Applicant's Statement: As
proposed, I request a variance for
the encroachment of 5 feet onto the
east setback. I have attempted
several other layout options, but
the existing one frame structure
contains the kitchen on the
southeast corner of the interior.
This location precludes placing a
continuous addition across the
entire rear of the structure
without blocking all the natural
lighting in the kitchen. Also,
because of the kitchen
configuration, there would be
serious access problems with a
continuous addition across the
rear. An added advantage to my
proposed addition to the east is
the creation of a private outdoor
area for my family's use.

B. Staff Analysis:
On March 30, 1998, the applicant approached the Board of
Adjustment with three variance requests:
1. A building line variance to allow a cover over the
existing front steps.
2. Building line and side yard setback variances to allow
a carport addition onto the east side of the house.
3. A side yard setback variance to allow a two-story
addition onto the east side of the house with a setback
of 3 feet.
The Board approved the first two variances but did not
approve the 3 foot side yard for the two story addition.
Staff had felt that a two story addition with a side yard of
only 3 feet would negatively impact the adjacent property.
Staff felt that a minimum setback of 5 feet would be more
reasonable.
The applicant is now requesting approval of a side yard
setback of 5 feet to allow for construction of the two story
addition onto the east side of the house. This request is
in line with staff's opinion and staff is comfortable
supporting the request. The code requires a side yard
setback of 6.5 feet for the lot. A 1 1/2 foot variance
should not have an impact on the adjacent property. The
adjacent property owner had written a letter in support of
the previously requested 3 foot side yard setback.
At its March 30, 1998 meeting, the Board did not
specifically deny the side yard setback variance. That
request was just not included in the motion to approve the
other variances.
C. Staff Recommendation:
Staff recommends approval of the requested side yard
variance to allow for construction of a two-story addition
with a reduced side yard setback of 5 feet subject to the
eave/overhang on the east side of the structure being
limited to no more than 12 inches.

Staff presented the item and a recommendation of approval subject
to the eave/overhang on the east side of the structure being
limited to no more than 12 inches.
