Public Works Issues: Z-6456 Kenneth and Dorothy Gill 721 North Oak Street Lot 12, Block 8, Auten and Moss Addition R-3 A variance is requested from the area regulations of Section 36-255 to permit construction of a carport addition with a reduced front yard. The site has no covered parking. The carport will be built over the existing parking pad. The slope of the property from "H" Street is too steep to construct a driveway and carport. Staff Analysis: The R-3 zoned property at 721 N. Oak Street is occupied by a one story, brick single family residence. A two car driveway accesses the site from Oak Street. There is no covered parking on site. The applicant proposes to construct a two -car carport addition onto the side of the house. The carport would be built over the existing paved driveway and would have a front yard setback of 8 feet. The Code requires a front yard setback of 25 feet for this lot. Although the front of the house faces "H" Street, the lot frontage and address is on the Oak Street side. Staff believes the request to be reasonable. The carport will be open and unenclosed with brick columns supporting the roof. The closest edge of the carport will be 23 feet from Oak Street itself. The slope of the property on "H" Street would make it very difficult to construct a driveway and carport on that side and due to the width of the lot, a variance would most likely be needed in that instance as well. The carport will be constructed over the existing driveway and allowing the reduced setback should have no effect on adjacent properties. C. Staff Recommendation: Staff recommends approval of the requested setback variance subject to the carport remaining open and unenclosed on all sides other than at the point it adjoins the house and compliance with Public Works comment. BOARD OF ADJUSTMENT: (FEBRUARY 23, 1998) The applicant was present. There were no objectors present. Staff presented the item and a recommendation of approval, subject to compliance with the conditions noted above. The applicant offered no additional comments. The item was placed on the Consent Agenda and approved as recommended by staff. The vote was 5 ayes, 0 noes, 1 absent and 3 open positions. 2
