Public Works Issues: Z-6444 Glenda Lewis 12400 Hunter's Glen Blvd. #1 Unit 9, Lot 1, Hunter's Glen MF -12 A variance is filed under the building line provisions of Section 31-12 to allow a swimming pool to be built across a platted 25 foot building line. This is the only area available on the site to place a pool. Placing the pool here will save 6 trees and the other extensive landscaping. Single Family residence Single Family residence The drainage and utility easement needs to be abandoned in this area. B. Staff Analysis: 12400 Hunter's Glen Blvd. is the address of the Countrywood Condominium development. The applicant's home is one of the detached dwellings located within the development. The house occupies most of the buildable area of the lot. The remainder of the lot is unbuildable due to access easements and building lines. The applicant proposes to have an,in- ground swimming pool installed behind her house. As proposed, the pool will be built across the 25 foot platted building line which extends along the north side of Hunter's Glen Blvd. Staff believes the variance request to be reasonable. The pool is to be located on the only available buildable area of the applicant's lot. The pool will be located behind the 6 foot tall brick wall which encloses the condominium development and will not be visible to anyone. The January 26, 1998 item No.: 4 Cont. Countrywood Board of Directors and the Countrywood Property Owner's Association have approved the applicant's plans. Should the Board approve the variance, the applicant will have to do a replat reflecting the change in the building line. The applicant should review the filing procedure with the Circuit Clerk's office to determine if the replat requires a revised Bill of Assurance. The replat will address the easement issue noted by Public Works. All utilities have approved the pool location. C. Staff Recommendation: Staff recommends approval of the requested building line variance subject to a replat reflecting the change in the building line as approved by the Board. BOARD OF ADJUSTMENT: (JANUARY 26, 1998) The applicant was present. There were no objectors present. Staff presented the item and a recommendation of approval subject to a one -lot replat. The applicant offered no additional comments. The item was placed on the Consent Agenda and approved subject to a one -lot replat reflecting the change in the building line. The vote was 5 ayes, 0 noes, 1 absent and 3 open positions. E
