Gallagher's Addition R-3 A variance is requested from the area regulations of Section 36-255 to permit construction of an addition with a reduced side yard setback. The second story addition and garage addition will maintain the setback of the existing house. It would be very difficult to change the setback due to the location of the existing house. Single Family residence Single Family residence The R-3 zoned property at 2615 Johnson Street is occupied by an older one-story frame residence. The owner of the home desires to substantially remodel the structure by adding a second floor to the house and a garage addition to the rear. The existing house has a side yard setback of 2 feet. The applicant desires to maintain the existing setback for the second floor addition and the garage. The code requires a side yard setback of 5 feet for this lot. Staff believes the variance request to be reasonable. Allowing the proposed expansion, with the reduced setback, should have no effect on adjacent properties. The property adjacent to the south is occupied by a small, boarded and vacant residential structure. This adjacent structure is set back 20+ feet from the side property line. Putting the November 24, 1997 Item No.: 10 Cont. second floor on the applicant's home does not increase the ground coverage of the house. The garage will be built over an existing concrete slab. The property is located in a neighborhood in which it is important to encourage investment such as that proposed by the applicant. There are many boarded structures, vacant lots and substandard dwellings in the area.. Staff would recommend that any eave or overhang on the south side of the home be limited to 12 inches and that the applicant install guttering to prevent water run-off onto the adjacent property. C. Staff Recommendation: Staff recommends approval of the requested side yard setback variance subject to compliance with the following conditions: 1. Any eave or overhang on the south side of the structure is to be limited to 12 inches. 2. Guttering is to be installed on the structure to prevent water run-off onto the adjacent property to the south. BOARD OF ADJUSTMENT: (NOVEMBER 24, 1997) The applicant was present. There were no objectors present. Staff presented the item and a recommendation of approval subject to compliance with the following conditions: 1. Any eave or overhang on the south side of the structure is to be limited to 12 inches. 2. Guttering is to be installed on the structure to prevent water run-off onto the adjacent property to the south. The applicant offered no additional comments. The item was placed on the Consent Agenda and approved as recommended by staff. The vote was 7 ayes, 0 noes, 0 absent and 2 open positions. 2
