Public Works Issues: Z-6420 John and Kristen Compton 5517 Hawthorne Lot 4 and East 1/2 of Lot 5, Block 8, Newton's Addition R-2 A variance is requested from the area regulations of Section 36-254 to permit construction of an addition with a reduced side yard setback. The existing detached garage will be removed. The new attached garage will maintain the same setback with a slight increase in the area. The new addition will be more aesthetically pleasing. Single Family residence Single Family residence The proposed 27' X 20' parking pad is a violation of city code and is not permitted. It is located entirely in the right-of-way. B. Staff Analysis: The owners of the R-2 zoned property located at 5517 Hawthorne Road propose to substantially remodel their home, including the construction of a large, one-story addition to the rear and side of the house. As part of the project the applicants proposed to remove an existing detached garage and construct in its place an addition to the house which will contain a new two -car garage. The existing detached garage has a side yard setback of 1.7 feet. The applicants desire to maintain that same setback for the new addition. Since the addition is part of the house, it must meet the required setbacks for the principal structure. The ordinance requires a side yard setback of 7.5 feet for this lot. S I November 24, 1997 Item No.: 8 Cont. Staff believes the variances request to be reasonable. The area of the proposed new garage which extends into the required setback just barely exceeds the area of the existing garage in that setback. The roof over the new garage will have a gable end facing the east property line so that no water will run off onto the neighbor's property. The house to the east is located on 3 lots and is set back 25'-30' from the side property line. A 8 foot tall privacy fence separates the two properties. Allowing this reduced side yard setback should have no increased impact on adjacent properties. The proposed parking pad to be located in the right-of-way is a violation of city code and cannot be allowed. C. Staff Recommendation: Staff recommends approval of the requested side yard variance subject to compliance with the following conditions: 1. Compliance with Public Works Comments to remove the proposed 27' X 20' parking pad. 2. The addition must be so designed so that water does not run off onto the neighboring property. BOARD OF ADJUSTMENT: (NOVEMBER 24, 1997) Carolyn Lindsey was present representing the applicant. There were no objectors present. Staff presented the item and a recommendation of approval subject to compliance with the following conditions: 1. Compliance with Public Works Comments to remove the proposed 27' X 20' parking pad. 2. The addition must be so designed so that water does not run off onto the neighboring property. Ms. Lindsey offered no additional comments. The item was placed on the Consent Agenda and approved as recommended by staff. The vote was 7 ayes, 0 noes, 0 absent and 2 open positions. 2
