Staff Analysis: Z-6413 Frank and Karen Howell 12480 Southridge Road Lot 36, Block 4, Walton Heights R-2 A variance is requested from the building line provisions of Section 31-12 to permit a porch which was built across a platted building line. ?ipplicantls Statement: The original porch was 5 ft. wide by 5 1/2 ft. deep and roof line stopped at structure, causing a water problem by sending water back under the house and into the garage. The porch was removed and replaced with a new porch and cover to extend the full length of the structure. The roof over the porch is constructed back into the original wall and roof framing of the house so as to make it part of the original structure. This eliminated any and all water problems. I feel it has greatly improved the appearance and the value of this home. Single Family residence Single Family residence The applicants are in the process of remodeling their home located on the R-2 zoned property at 12480 Southridge Road. As part of the project, they removed the existing porch and November 24, 1997 Item No.: 5 (.Cont. replaced it with a new porch which extends the full length of the house. The new porch was built maintaining the same setback and width of the old porch. The applicants were unaware that the old porch extended approximately 3 feet across a platted 25 foot building line. The entire new porch now extends 2-3 feet across the building line. The applicants state that the new, covered porch was constructed, in part, to eliminate a water run-off problem and to add to the aesthetic value of the home. Staff believes the requested variance is reasonable and should have no effect on neighboring properties. The porch is set back 35± feet from the curb of Southridge Drive. The building line intrusion varies in width from 2 feet to 3 feet. This relatively minor encroachment is not readily visible to the naked eye. Should the Board approve the variance, the applicant will have to do a one -lot replat reflecting the change in the building line. The applicant should review the filing procedure with the Circuit Clerk's Office to determine if the replat requires a revised Bill of Assurance. C. Staff Recommendation: Staff recommends approval of the requested building line variance subject to a one -lot replat reflecting the change in the building line as approved by the Board. BOARD OF ADJUSTMENT: (NOVEMBER 24, 1997) The applicant was present. There were no objectors present. Staff presented the item and a recommendation of approval subject to a one -lot replat reflecting the change in the building line. The applicant offered no additional comments. The item was placed on the Consent Agenda and approved as recommended by staff. The vote was 7 ayes, 0 noes, 0 absent and 2 open positions. 2
