A variance is requested from the
area regulations of Section 36-254
to permit an addition with a
reduced side yard setback.

B. Staff Analysis:
The R-2 zoned property located at 5411 Edgewood is occupied
by a two-story, frame single-family residence. The
occupants of the home are proposing to substantially remodel
it, including the construction of additions to the rear and
the side. The addition on the side will contain a 2 car
carport with a future second floor above it. This addition
is proposed to have a side yard setback of 5 feet. The code
requires a side yard setback of 7 feet for this lot.
Staff believes the variance request to be reasonable. This
home currently has no covered parking. It appears the
carport/garage was enclosed several years ago. The proposed
side yard setback of 5 feet is not out of character with the
neighborhood. The home on the adjacent property is
constructed so that its 2 car carport is on the applicant's
side of the property. This carport to carport relationship
should help to mitigate the impact of the applicant's
proposal. The structure on the adjacent lot appears of have

side yard setback of 8 feet. Staff believes it is
reasonable to limit the amount of eave/overhang so as to
provide the maximum amount of open space/separation between
the new addition and the side property line.
C. Staff Recommendation:
Staff recommends approval of the requested side yard setback
variance subject to compliance with the following
conditions:
1. The existing concrete driveway and walk are to be
removed and the curb of Edgewood Road repaired (as
proposed by the applicant.)
2. The eave/overhang on the side of the addition is limited
to a maximum of 12 inches.

Carolyn Lindsey was present representing the applicants. There
were no objectors present. Staff presented the item and a
recommendation of approval subject to compliance with the two
conditions noted in the "Staff Recommendation" above. Ms.
Lindsey offered no additional comments.
The item was placed on the Consent Agenda and approved subject
to compliance with the two conditions outlined in the "Staff
Recommendation." The vote was 7 ayes, 0 noes, 0 absent and
2 open position.
