Public Works Issues: Z-6391 Harcros Chemicals, Inc. 3100 West 65th Street Long legal I-2 A variance is requested from the area regulations of Section 36-320. The proposed covered working platform are over an existing tank area. Chemical plant Chemical plant landing and to be built containment 1. There exists a deferral of street improvements to Murray and the corner radius until June of 2001. 2. Stormwater detention ordinance applies to this property. B. Staff Analysis: Harcros Chemical Company occupies the I-2 zoned property located at 3100 West 65th Street. A chemical tank containment area is located on the northern (rear) perimeter of the property. The large tanks are contained within a dike wall which has a setback of approximately 2 feet from the north (rear) property line. Harcros proposes to construct stairs and a covered landing over the existing tank containment area, maintaining the existing setbacks. City Code requires a rear yard setback of 25 feet in the I-2 district. Staff believes the variance request to be reasonable. The proposed stairs and covered working platform will be built over the existing tank containment area and will maintain the existing setbacks. No greater setback variance is created by the addition of the stairs and covered platform. The property to the north is also occupied by an industrial use. A parking lot and outdoor storage area on this adjacent property provide separation between the applicant's October 27, 1997 Item No.: A (Cont.) -- proposed improvements and the neighboring building to the north. C. Staff Recommendation: Staff recommends approval of the requested setback variance subject to compliance with Public Works Comments. BOARD OF ADJUSTMENT: (SEPTEMBER 29, 1997) The applicant was not present. There were no objectors present. Staff informed the Board that the applicant had failed to send the required notice of public hearing and the item needed to be deferred to the October 27, 1997 meeting. The item was placed on the Consent Agenda and deferred to the October 27, 1997 meeting by a vote of 5 ayes, 0 noes, 3 absent and 1 open position. BOARD OF ADJUSTMENT: (OCTOBER 27, 1997) The applicant was present. There were no objectors present. Staff presented the item and a recommendation of approval subject to compliance with Public Works Comments. The applicant offered no additional comments. The item was placed on the Consent Agenda and approved as recommended by staff. The vote was 7 ayes, 0 noes, 0 absent and 2 open positions.
