A variance is requested from the
fence height provisions of Section
36-516.
The fence is needed for security
purposes and to contain a
protection dog. The fence would
match a 6 foot tall fence on the
bordering property.

The R-2 zoned property at 6807 Brodie Lane is occupied by a
one story, single family residence. Most of the property is
bordered by a 6 foot tall, wood privacy fence. The
applicant wishes to extend the fence across the front
property line, to completely enclose the property. Section
36-516 of the City code limits the height of fences erected
within required setbacks adjacent to streets to 4 feet.
Staff believes the variance request to be reasonable. This
property is located in a rural area of the City.
Surrounding uses range from single family homes and a school
to a variety of Industrial uses. Some of the industrial
uses are located to the north of this site and across Brodie
Lane, to the west. The applicants state that they have a
dog which they feel would not be contained within a 4 foot
tall fence. The residence adjacent to the north has also
erected a similar fence in his front yard. The applicant's
fence would match this neighboring fence. The fence would

have a setback of 15± feet from the edge of the street so it
should not affect traffic.
C. Staff Recommendation:
Staff recommends approval of the requested fence height
variance subject to the finished side of the fence facing
outward.

The applicants, Paul and Barbara Welsh, were present. There were
no objectors present. Staff presented the item and a
recommendation of approval subject to the finished side of the
fence facing outward.
Mr. and Mrs. Welsh offered no additional comments.
The item was placed on the Consent Agenda and approved subject
to the finished side of the fence facing outward by a vote of
5 ayes, 0 noes, 3 absent and 1 open position.
