The R-3 zoned property at 3416 "I" Street is currently
occupied by an older, two-story residential structure. The
applicants recently purchased the property and are in the
process of remodeling the home. Included in the remodeling
project is a proposed garage addition onto the front of the
house. In preparation for this proposed expansion, the
applicant recently petitioned the City for abandonment of a
portion of the rights-of-way of "I" Street and Valentine
Street, adjacent to the south and west of this site. The
abandonment will increase the area of the applicant's
property enough to accommodate the proposed garage addition.
The Planning Commission approved the abandonment application
on August 7, 1997. The issue was scheduled to be heard by
the Board of Directors on September 16, 1997. This
application was filed in anticipation that the abandonment
will have been approved by the Board. With the addition of
the former right-of-way, the proposed garage will have a

front and side yard setback of 0-1 feet. The Ordinance
requires a front yard setback of 25 feet and a side yard
setback of 5 feet for this lot.
This is a very unusual situation and staff's recommendation
of approval takes some explanation. From the day the right-
of-way abandonment was filed in June 1997, it was known what
was proposed by the applicant. The site plan was reviewed
by all involved City departments, including Fire and Public
Works, and all public utility companies. What the Board
sees before it is a result of that review.
"I" Street dead -ends at the western edge of this property.
The street itself is very substandard and serves as access
to only 7 residences. The garage will have a setback of 16-
17 feet from the edge of the street itself. The severe
slope of the property substantially limits the buildable
area available on the lot.
As proposed, the garage addition will have a setback of 0-1
feet on the front and side. The applicant must be aware
that no portion of the structure, including eaves and
overhangs, may extend beyond the property line. It may be
necessary to make minor adjustments in the positioning of
the garage to assure that this occurs.
C. Staff Recommendation:
Staff recommends approval of the requested front and side
yard setback variances subject to no portion of the
structure, including eaves and overhangs, extending beyond
the property line.
BOARD OF ADJUSTMENT: (SEPTEMBER 29, 1997)
The applicant, Cal Ledbetter, was present. There were no
objectors present. Staff presented the item and recommended
approval subject to no portion of the structure, including eaves
and overhangs, extending beyond the property line.
Mr. Ledbetter offered no additional comments.
The item was placed on the Consent Agenda and approved subject to
the condition noted in the staff recommendation by a vote of
5 ayes, 0 noes, 3 absent and 1 open position.
