Public Works Comments: No Comments. Z-6370 John and Polly Russell 2612 Crouchwood Lot 29, Kingwood Place Addition R-2 A variance is requested from the area regulations of Section 36-254. Applicant's Statement: We ask for a variance to the zoning codes regarding the deck for several reasons. We put up the deck not knowing what the codes were concerning the deck. The fencing that surrounds the deck was built before we decided to build the decking. Upon looking at the property lines in question we thought the decking would be a perfect fit. It was just a long narrow pathway down to the,back yard with a rather drastic elevation drop (about 2.5. feet drop per 8 feet in length). The area was not good for anything but an accident. We then proceeded to build the decking with the blessing of our next door neighbor that the decking directly affects. B. staff Analysis: The applicants have recently constructed a deck addition onto the side of their home located on the R-2 zoned property at 2612 Crouchwood. The deck extends to the side property line. The code requires a side yard setback of 5.6 feet for this lot. upon being notified that the deck is in violation of the setback requirements, the applicants filed for a variance. Staff feels that the request is reasonable. The floor of the deck is 2.5 feet above grade with only handrails extending above that. The deck is uncovered and unenclosed so it functions as not much more than a raised patio. The entire structure is hidden behind a privacy fence. The deck should have no impact on adjacent properties. C. Staff Recommendation: Staff recommends approval of the requested side yard setback variance subject to compliance with the following conditions: 1. The deck is to remain uncovered and unenclosed. 2. Building permit must be obtained. BOARD OF ADJUSTMENT: (AUGUST 25,, 1997) The applicant, John Russell, was present. There were no objectors present. Staff presented the item and a recommendation of approval, with conditions. Mr. Russell stated that he understood staff's recommendation. He presented a letter from his next door neighbor, Steven Allen of 2616 Crouchwood, stating that Mr. Allen approved of the variance request for the deck. The question was called on the variance request, subject to compliance with the conditions noted in the staff recommendation. The vote was 8 ayes, 0 noes and 1 absent, approving the variance.
