variances are requested from the
building line provisions of Section
31-12, the accessory building area
regulations of Section 36-156 and
the fence height regulations of
Section 36-516.
The excessive slope of the property
and the presence of several trees
dictated that the pool be placed in
this location. A 6 foot fence is
needed to provide some level of
privacy.

The applicant has recently constructed a 17 foot by 32 foot
swimming pool and associated deck on the R-2 zoned property
located at #1 Amarillo Circle. A portion of the pool and
deck extend beyond the 25 foot building line on the Del Rio
Drive side of the property. The deck has a setback of 7.1
feet from the Del Rio side property line. The code requires
accessory structures to maintain a minimum street side yard
setback of 15 feet. Additionally, the applicant proposes to
enclose the rear yard with a 6 foot tall privacy fence. The
Ordinance limits the height of fences within required
setbacks adjacent to streets to 4 feet.

The property has a fairly substantial slope down from the
northeast to the southwest. The applicant states that it
was this slope as well as the presence of several trees that
prompted him to place the pool and deck where they are. The
slope is such that the deck is at grade near the house and
5-6 feet above grade on the south side.
Staff does not believe the pool and deck will have an
adverse effect on adjacent properties. Allowing the 6 foot
privacy fence should not have an impact either. The fence
is located far enough away from the intersection so as not
to create a sight -distance problem.
If the Board should approve the building line variance, the
applicant will have to do a one -lot replat reflecting the
change in the building line. The applicant should review
the filing procedure with the Circuit Clerk to determine if
the replat requires a revised Bill of Assurance.
C. Staff Recommendation:
Staff recommends approval of the requested building line,
setback and fence height variances subject to compliance
with the following conditions:
1. A one -lot replat reflecting the change in the building
line as approved by the Board.
2. The privacy fence is to be designed with the finished
side facing outward.
3. Building permits must be obtained.
BOARD OF ADJUSTMENT: (AUGUST 25, 1997)
Gary Melton was present representing the application. There were
no objectors present. Staff presented the item and a
recommendation of approval, with conditions.
Mr. Melton said the site for the pool and deck was chosen due to
the slope of the property and the presence of several trees. He
stated that he understood staff's recommendation.
A motion was made to approve the requested variances subject to
compliance with those conditions noted in the staff
recommendation. The motion was approved by a vote of 8 ayes,
0 noes and 1 absent.
