Public Works Issues: Z-6344 Clay Murphy 303 Hickory Court NW Lot 16R, Hickory Subdivision R-2 A variance is requested from the fence height provisions of Section 36-516 to permit construction of a 10 foot tall wall. The wall will match in style and height a wall already existing on one property line. The wall will provide security against the wooded and undeveloped property to the rear. Single Family Single Family Private drainage and streets access to utility/drainage will be limited by construction of wall. Opening will be required in wall for drainage. B. Staff Analysis: The applicant proposes to construct a 10 foot tall wall on the side and rear property lines of the R-2 zoned lot located at 303 Hickory Court NW. The Ordinance limits the height of such structures to 6 feet. The property is located in the gated Hickory Creek neighborhood and backs up to a large undeveloped, wooded tract. A new two-story brick home is currently being constructed on the lot. The proposed wall is not out of character with other properties in this area of Hickory Creek, those on the July 28, 1997 Item No.: 6 (Cont. western perimeter of the subdivision. The Board recently approved a similar structure for the property adjacent to the south. This previous Board action approved a 10 foot tall wall on the property line between this property and the property to the south. The applicant proposes to tie in to this previously approved wall and continue it on the rear and north perimeters. The wall will be built of brick, finished to match the architecture of the house. The proposed wall will tie into the front corners of the house, enclosing the rear yard. The property two lots to the south also has a similar wall. C. Staff Recommendation: Staff recommends approval of the requested height variance for the proposed wall. BOARD OF ADJUSTMENT: (JULY 28, 1997) The Chairman asked Mr. Wood, of the Staff, to present the item and a recommendation. Wood indicated that this is a new construction request and identified the specific application and noted that the staff recommends approval of the requested height variance for the proposed wall. He further indicated that this would be a continuation of and a tie to adjacent neighbor walls of similar nature. The Chairman then asked a representative of the owner to come forward. Mr. Branch identifying himself as the builder for Mr. Murphy was present offering a brief statement of the proposal. At the conclusion of his remarks, the Chairman asked if there were objectors in attendance. There were none noted. At this point, a member of the Board, Ann Palmer asked a question of staff or others that may be able to answer as to the specific issue associated with drainage as related to construction of the wall. Several persons offered commentary on this subject basically replying that in constructing a wall of solid masonry it is necessary to include drainage to prevent backing up surface water. At the conclusion of this discussion, the Chairman asked if there were other issues to discuss. There being none, the Chairman asked for a motion on the application. A motion was made to approve the height variance as requested. The motion passed by a vote of 8 ayes, 0 nays and 1 absent. 2
