A variance is requested from the
building line provisions of Section
31-12 to permit a deck built across
a platted building line.
The deck is already built. The
deck is no more than 12 inches
above grade with only the railing
extending above that. The deck
replaced a cracked concrete porch
and adds to the beauty of the
house.

This issue is before the Board as a result of action by the
Codes Enforcement Staff.
The applicant has constructed a wood deck addition on to the
front of the house located on the R-2 zoned property at 7015
Shamrock. The deck extends approximately 7-8 feet across a
platted 25 foot building line. The deck itself is no more
than 12 inches above grade, however it does have railings
and built in benches.
Staff believes the variance request to be reasonable. The
deck was built to replace a cracked concrete porch. Other
than the railings and benches, the deck itself does not
exceed 12 inches above grade. The portion of the deck which

extends beyond the building line will not be covered.
Although the deck has a front yard setback of 17-18 feet, it
is located 27-28 feet from the curb of Shamrock Drive
itself. Due to the severe slope of the rear yard, there is
limited area available for outdoor seating and activities.
If the building line variance is approved, the applicant
will have to do a one lot replat reflecting the change in
the building line. The applicant should review the filing
procedure with the Circuit Clerk to determine if the replat
requires a revised Bill of Assurance.
C. Staff Recommendation:
Staff recommends approval of the requested building line
variance subject to the following conditions:
1. A one -lot replat reflecting the change in the building
line as approved by the Board.
2. The portion of the deck which extends beyond the 25
foot setback/building line is not to be covered or
enclosed.
BOARD OF ADJUSTMENT: (JULY 28, 1997)
The Chairman asked Mr. Wood, of the Staff, to present the item.
Wood offered the Staff Recommendation with the suggested
conditions should the Board approve the variance. The Chairman
then asked the applicant to come forward and address the issue.
Mr. Godwin was in attendance and he offered brief comments as to
his circumstance and need for retaining the structure. The
Chairman then asked if there were objectors. There were none in
attendance. After a brief discussion, the Chairman asked for a
motion on the variance. A motion was offered to approve the
application as filed subject to the staff recommendations. A
vote on the motion passed by 8 ayes, 0 nays and 1 absent.
