Justification: Applicant's Statement: I have lived in Homestead, Florida for 35 years. I moved here to Little Rock, Arkansas because of my mother's health. She had to have both of her legs amputated. She was learning how to walk when she fell and broke her hip. I have had the carport added for the handicapped to protect us from the weather elements. It is very hard to remove people from a vehicle when they can't walk. I am appealing to you to let me keep it. Staff Analysis: This issue is before the Board as a result of action by the Codes Enforcement Staff. The applicant has placed a metal, 12 foot by 20 foot carport structure on the R-2 zoned lot located at 5910 Freeland Drive. The carport is built across a platted 35 foot building line, has a front yard setback of 15± feet and is separated from the house by 5 feet. The Ordinance requires accessory buildings to have a front yard setback of at least 60 feet and to be separated from the principal structure by at least 6 feet. Staff believes the variance requests to be reasonable. The house at 5910 Freeland has no covered parking, it appears the carport or garage were at one time enclosed. The applicant has stated that she and other family members are handicapped and would like to have covered parking, especially in times of inclement weather. The structure does have a front yard setback of only 15 feet, however it does sit approximately 25± feet from the curb of the street. The property is located at the end of a cul-de-sac with minimal vehicle traffic. The 6 foot separation requirement is primarily a fire prevention issue. The carport structure is constructed entirely of metal. The sides of the structure are unenclosed, allowing full access to the residence. If the Board approves the building line variance, the applicant will have to do a one lot replat reflecting the change in the building line. The applicant should review the filing procedure with the Circuit Clerk to determine if the replat requires a revised Bill of Assurance. C. Staff Recommendation: Staff recommends approval of the requested setback, separation and building line variances subject to compliance with the following conditions: 1. A one lot replat reflecting the change in the building line as approved by the Board. 2. The carport is to remain open and unenclosed on all sides. BOARD OF ADJUSTMENT: (JULY 28, 1997) Richard wood, of the Staff, offered the Staff Recommendation which is approval of the requested variance with conditions. The Chairman then asked the applicant to come forward. She presented 2 July 28, 1997 Item No.: 2 (Cont. brief comments concerning how she managed to be requesting this variance. The Chairman asked if there were other persons present involved in this issue. There were no objectors noted. The Chairman asked Mrs. Koski if she had any problems with staff recommendation. She indicated that she did not. Following a brief discussion, the Chairman asked for a motion on this request. A motion was made to approve the variance subject to the staff conditions. A vote on the motion produced a vote of 8 ayes, 0 nays and 1 absent. K1
