Justification: Applicant's Statement: We request a variance for the home at 2317 N. Beechwood for the following reasons. The existing home has a 4 foot rear yard setback. To correct water problems in the basement, part of the old structure needs to be removed and rebuilt. The owners also have a handicapped son and the updating of the home would be of great significance to the well being of the handicapped child. Therefore, we are requesting .to have the 25 foot rear yard setback waived and keep the original 4 foot rear yard setback, as the existing house is now. Staff Analysis: The applicants propose to remodel the single family residence located on the R-2 zoned property at 2317 Beechwood. This project includes the removal of a substantial portion of the rear of the house and replacing it with a new two-story addition. The portion of the house to be removed now has a rear yard setback of 4 feet. The applicant proposes to maintain that same setback with the new addition. The Ordinance requires a rear yard setback of 25 feet for this lot. Staff believes the variance request to be reasonable since the applicant proposes to basically replace what is being removed. Severe water problems have necessitated the remodeling. The new addition is not much larger that the area which it is replacing. All abutting residential property owners, including the one adjacent to the rear, have submitted letters in support of the project. The upper floor of the new addition contains guest quarters. The plans as originally submitted showed a kitchen in this area. At staff's request, the kitchen has been removed from this area. C. Staff Recommendation: Staff recommends approval of the requested rear yard setback variance. BOARD OF ADJUSTMENT (JUNE 30, 1997) Jack Hartsell was present representing the application. There were no objectors present. Staff presented the item and a recommendation of approval. Staff informed the Board that the applicant had only notified the adjacent residential property owners and not all property owners within 200 feet as required by the Board's bylaws. After a brief discussion, a motion was made to accept the notices as done by the applicant and to waive the bylaws. The motion was approved by a vote of 6 ayes, 1 noe and 2 absent. Mr. Hartsell briefly discussed the drainage problems on the site. A motion was made to approve the requested rear yard setback variance. The motion was approved by a vote of 7 ayes, 0 noes and 2 absent. 0�
