Justification: Applicant's Statement: I had a
carport cover (metal) installed for
my daughter's vehicle. The work
was done by Lindsey's Pools and
Spas. I trusted him and assumed he
did what was necessary since he was
a businessman. I had no idea I was
doing anything wrong.
I am appealing to you to let me
keep it. My daughter and I have
spent our hard earned dollars
($1,338.78) for a cover for
protection of her vehicle. It not
only looks good, it improves the
looks of my property. It is so
very disturbing to work all your
life and keep trying to improve
where you live and do what is
right. Then, you find out you
weren't told what needed to be
done.

H. Staff Analysis:
This issue is before the Hoard as a result of action by the
Codes Enforcement Staff.
The applicant has placed a 16 foot by 20 foot, metal carport
structure on the R-2 zoned lot located at 29 Rolling Lane.
The structure has a side yard setback of 0 feet, a front
yard setback of 50± feet and is separated from the house by
approximately 1 foot. The Ordinance requires accessory
buildings to have minimum side yard setbacks of 3 feet, a
minimum front yard setback of 60 feet and to be separated
from the principal structure by a minimum of 6 feet.
The structure is located behind the house and access is
gained by a driveway which extends from Rolling Lane, beside
the house.
Staff believes the variance requests to be reasonable. The
6 foot building separation is primarily a fire protection
issue. This carport structure is constructed completely of
metal and is open on the sides nearest the house so that
access to the house is readily available. Typically, staff
has concerns about structures with proposed yard setbacks of
0 feet. Such issues as water run-off and the relationship
to structures on abutting properties must be addressed.
This structure has a curved roof so that water runs down the
side of the structure and not onto the neighboring property.
There are no structures on the neighboring property in the
immediate vicinity of this carport. The structure is
located behind the applicant's home and allowing the reduced
front yard setback of 50± feet should have no impact on
neighboring properties.
The carport is not out of character with similar structures
in the area. The property directly adjacent to the south
and one across Rolling Lane to the west have similar carport
structures.
C. Staff Recommendation:
Staff recommends approval of the requested side yard
setback, front yard setback and separation variances subject
to the carport structure not being enclosed on the west and
south sides so that Fire Department access may be
maintained.

Richard Wood, of the Staff, offered the item for consideration
and extended the Staff Recommendation with the conditions noted.
The Chairman asked the applicant to come forward and to address
the issue.
Mrs. Larch identified herself for the record and stated her
intentions with respect to keeping the carport as indicated in
the agenda. After being questioned by the Chairman, she
indicated that the conditions set by the staff were acceptable.
The Chairman then noted that there were no objectors in
attendance. After a brief discussion, the Chairman asked for a
motion. A motion was made to approve the variance request as
presented subject to the staff conditions. A vote on the motion
produced a vote of 8 ayes, 0 nays and 1 absent.
