Applicant's Statement: This applicant desires to construct additional parking for his business. He recently purchased the 1.14 acre tract, zoned R-2, adjacent to the property on which his present business is located, zoned 0-3. The applicant is requesting this variance to allow parking to serve his business on R-2 zoned property due to the fact that his business is currently inadequately served with the existing parking and the area available for parking that now exists on the site. The applicant originally intended to re -zone the property to allow for this use but was instructed by staff that the Planning Commission had recently ruled to not allow any revisions to the Land Use Plan in this area to allow for rezoning of any lands designated as Single Family Residential to Commercial use. June 30, 1997 Item No.: 12 (Cont.) Present Use of Property; Vacant proposed Use of Proper: Parking lot staff Rep -0 -rt: A. Public Works Issues: 1. Dedicate right-of-way to 55 feet from centerline construct Phase I, principal arterial improvements with sidewalks. 2. Remove parking from right-of-way. 3. Driveways shall conform to Section 31-210 or Ordinance 16,577. 4. Stormwater detention ordinance applies to this property. 5. Plans of all work in right-of-way shall be submitted for approval prior to start of work. 6. Grading permit will be required on this new development, if it disturbs more than one acre. B. Staff Analysis: Daniel Utility is located on the 0-3 zoned property at 9715 Colonel Glenn Road. The property is relatively deep however, only the front portion adjacent to the street is zoned 0-3. There is currently inadequate area available for customer and employee parking. The company has recently acquired the 1.14 acre tract adjacent to west. This adjacent property is zoned R-2. Daniel Utility would like to develop additional employee and customer parking on a portion of this R-2 zoned tract. The portion to be developed would extend approximately 160 feet south of the street, the remaining 500± feet of the tract will remain undeveloped. Staff believes the request is reasonable. This narrow (75 feet wide) tract is located between Daniel Utility and a single family residence. The biggest portion of the tract will remain undeveloped. The new parking lot will be developed in full compliance with City Code, including landscaping and screening to shield the adjacent single family residence. Any lighting will have to be low-level and directional, aimed away from adjacent residential properties. Daniel Utility currently parks business related equipment on the 0-3 zoned site. No portion of this R-2 zoned property may be used for parking of equipment or storage of materials. In response to Public Works Comments, the applicant will submit a revised plan reflecting the new right-of-way and K June 30, 1997 Item No.: 12 (Cont. adjusting the location of the parking lot to accommodate the new right-of-way line. C. Staff Recommendation: Staff recommends approval of the variance to allow a portion of this R-2 zoned property to be used as a parking lot -for Daniel Utility subject to the following conditions.- 1. onditions: 1. Compliance with Public Works Comments 2. Compliance with the City's Landscape and Buffer Ordinances 3. No portion of this R-2 zoned property may be used for parking of equipment or storage of materials; including trailers. 4. The parking lot is to be used for employee or customer parking. 5. Any lighting is to be low-level and directional, aimed away from adjacent residential properties. BOARD OF ADJUSTMENT: (JUNE 30, 1997) The applicant was not present. There was one objector present. Staff informed the Board that the applicant had requested that the item be withdrawn. Staff had raised questions regarding the applicant's use of the 0-3 zoned property to the east. These questions may require actions beyond the purview of the Board of Adjustment. A vote was taken on the applicant's request for withdrawal, without prejudice. The vote was 7 ayes, 0 noes and 2 absent. 3
