A variance is requested from the
area regulations of Section 36-301
to permit construction of a new
store with reduced rear yard
setback.
Applicant's Statement: We are
requesting a waiver of the 25, rear
set -back requirement so we may
construct an 8,000 square foot
retail store on this property and
meet the parking and landscaping
requirements of the city and our
proposed tenant. The unusual lot
configurations does not allow for a
good parking lot design and meeting
the 25, set -back requirement would
reduce the number of parking spaces
below the requirement of the city
and of our tenant.

1. Proposed driveways violate City code section 31-210 which
limits driveways to a spacing of 300 feet on collectors,
common drives with adjacent lots are recommended.
Redesign plan and resubmit. Grading permit will be
required on this new development, if it disturbs more
than one acre.
2. All driveways shall have concrete aprons per City
Ordinance.
3. Stormwater detention ordinance applies to this property.

4. Property frontage needs to have the sidewalks and ramps
brought up to the current ADA standards with any planned
construction.
5. Utility excavation within proposed rights-of-way shall be
per Article V of Section 30.
B. staff Analysis:
Family Dollar Store proposes to construct an 8,000 square
foot retail store on the C-3 zoned .65± acre lot located at
7010 West 36`h Street. The property is an outparcel located
between the Harvest Foods Store and West 36`h Street. In
order to accommodate the needed square footage as well as
the required parking and landscape areas, the applicant is
proposing a reduced rear yard setback of 3 feet for the new
building. The ordinance requires a rear yard setback of 25
feet for this lot.
Staff believes the request to be reasonable. All abutting
properties are zoned C-3. A 60 foot wide, asphalt driveway
and parking lot separate this site from the west side wall
of the Harvest Foods Store.
There are substantial problems with the site plan submitted
with this application. As noted, the driveways violate city
code and must be redesigned. The applicant has indicated
that Harvest Foods refuses to allow access from their lot so
this site must be redesigned with only one driveway off of
West 36`h Street. Building, perimeter and interior
landscaping fall below the minimum code requirements.

Tommy Lasiter was present representing the application. There
were no objectors present. Staff presented the item and informed
the Board that the applicant had submitted a revised plan which
appeared to address staff concerns regarding landscaping and
driveways. Staff offered a recommendation of approval, with
conditions. Staff also informed the Board that the applicant had
sent the notice of public hearing 7 days prior to the hearing,
not 10 days as is required by the Board's Bylaws.

Mr. Lasiter stated that there were only 3 property owners within
200 feet, as certified by an abstract company, and that he had
received the return cards on all three. A motion was made to
waive the Bylaws and accept the notices as done by the applicant.
The motion was approved by a vote of 8 ayes, 0 noes and 1 absent.
A motion was made to approve the rear yard setback variance
subject to compliance with Public Works Comments and the City's
Landscape and Buffer ordinances. The motion was approved by a
vote of 8 ayes, 0 noes and 1 absent.
