Variance Reuuested: Variances are requested from the
area regulations of Section 36-254
and the building line provisions of
Section 31-12 to permit
construction of a carport with
reduced sideyard setback and which
crosses a platted 30 foot building
line.
Justification: Applicant's Statement: The Heights
is known for its large and mature
trees, and we agree strongly with
the preservation of this important
natural feature. However, even
after proper trimming, the existing
trees around our property continue
to drop extensive debris (includes
acorns and hickory nuts) which has
already caused damage to our
vehicles. Also, with the severe
weather we have in Arkansas (hail
storms) we feel that a carport has
become a must to protect our
vehicles. Certainly a carport
would be an added convenience while
walking from our house to our cars
especially during inclement
weather. The properly designed and
constructed carport also would be a
beneficial architectural addition
to our house, our neighborhood, and
the Heights in general. Finally,
with a limited 50 foot width lot
configuration which is common in
our neighborhood, building new
additions often requires the use of
the full property lines.

B. Staff Analysis:

The applicants propose to construct a carport addition onto
the residence located on the R-2 zoned lot at 1919 N. Monroe
Street. The proposed carport will have a side yard setback
of 1.3 feet and will cross a platted 30 foot building line.
The Ordinance requires a side yard setback of 5 feet for
this lot. The carport will be built to match the overall
design and architecture of the house and will be built over
the existing concrete driveway.
Due to the angle of the house in relationship to the front
property line, the carport will encroach on the building
line by only 2 feet at one corner. The structure will have
the same setback as the front porch.
The carport will be open and unenclosed which will help to
mitigate the impact of the reduced side yard setback.
Guttering will be installed to prohibit water run-off onto
the adjacent lot.
Staff believes the applicant has submitted reasonable
justification to support the requested variances. If the
building line variance is approved, the applicant will have
to do a one -lot replat to reflect the change as approved by
the Board. The applicant should review the filing procedure
with the Circuit Clerk to determine if the replat requires a
revised Bill of Assurance.
C. Staff Recommendation:
Staff recommends approval of the requested building line and
side yard setback variances subject to the following
conditions:
1. A one -lot replat reflecting the change in the building
line as approved by the Board.
2. The carport is to remain open and unenclosed on all sides
other than at the point it adjoins the house.

3. Guttering is to be installed on the carport to prohibit
water run-off onto the adjacent property.
4. The closest edge of the carport addition, including
guttering, is not to be any closer than 1 foot from the
south side property line.
BOARD OF ADJUSTMENT:
(JUNE 30, 1997)
Claudia Barone and Bill Hearnsberger were present representing
the application. There was one objector present. Staff
presented the item and a recommendation of approval, with
conditions.
Ms. Barone offered no additional comments other than to state
that she understood staff's recommendation.
Ralph Walsh, representing his mother who owns the house at 1910
N. Monroe, spoke in opposition to the variance request. He
presented photographs showing the relationship of the two houses
and stated that allowing the carport would bring the two homes
too close together. Mr. Walsh stated that his mother's home had
a side yard setback of 5 feet 2 inches. He stated that the
Barons had a two car garage and paved parking in front of the
garage. Mr. Walsh also stated that the proposed carport could be
less than 14 feet in width.
In response to a question from Ann Palmer, Ms. Barone stated that
she would like to have covered parking adjacent to the house even
though they have a detached garage. She stated such arrangements
are not unusual in the Heights.
Kirby Rowland asked if any trees would have to be removed to make
way for the carport. Ms. Barone responded that no trees would be
removed and any other plantings which are removed would be
replaced.

conditions as recommended by staff. The
