A variance is requested from the
building line provisions of Section
31-12 to permit construction across
a platted 25 foot building line.
The interior layout of the house
dictates that the proposed addition
be located as shown.

The applicant proposes to remodel the house located on the
R-2 zoned property at 10813 Valiant Drive. This remodeling
includes expansion of a bedroom and bathroom. To
accommodate the construction, the applicant proposes to
construct a 5 foot addition on the south side of the house.
This addition will cross a platted 25 foot building line.
Due to the angle of the house in relationship to the
property line, the addition will have an encroachment of 4
feet at the front and will taper to approximately 2 feet at
the rear. The addition will maintain a setback of 32-33
feet from the curb of Yorkwood Drive.
The addition must be placed at this point to accommodate the
expansion of the existing bedroom and bathroom. Staff
believes this relatively minor variance will have no impact
on adjacent properties.

If the building line variance is approved, the applicant
will have to do a one -lot replat to reflect the change as
approved by the Board. The applicant should review the
filing procedure with the Circuit Clerk to determine if the
replat requires a revised Bill of Assurance.
C. staff Recommendation:
Staff recommends approval of the requested building line
variance subject to a one -lot replat reflecting the change
in the building line as approved by the Board.

The applicant, John Lamb, was present. There were no objectors
present. Staff presented the item and a recommendation of
approval subject to a one lot replat.
Mr. Lamb offered no additional comments other than to state that
he understood staff's recommendation.
The vote was called on the building line variance request subject
to a one lot replat. The vote was 8 ayes, 0 noes and 1 absent.
