Applicant's Statement: I am the owner of the property located at 31 Bradbury Drive, Little Rock, Arkansas, and I am submitting an application for variance from the requirements of the City's zoning ordinance. Specifically, I want to locate an accessory building closer to my house than the six (6) foot distance allowed by the separation provisions of Section 36-156 of the Little Rock Code of Ordinances. I am seeking this variance for a variety of reasons. First, my back yard slopes steeply, making a satisfactory, level placement of the accessory building much more difficult. I have a concrete patio adjacent to the rear of my house which is approximately twelve (12) feet wide, is level, and will adequately accommodate a 12' X 8' building I propose to purchase. Also, location of this building next to my house will make it completely invisible from the street and virtually invisible to my neighbors due to my fencing, existing decking, and landscaping. Single Family The applicant proposes to place a 12 foot by 8 foot accessory building in the rear yard of the R-2 zoned property located at 31 Bradbury Drive. The structure is to be placed on a concrete patio located directly behind the house and will be separated from the house by approximately 1 foot. Section 36-156 requires accessory buildings to be separated from principle buildings by at least 6 feet. Due to the severe slope of the property, it would be very difficult to place the building anywhere else on the site. The property slopes down from the street toward the rear property line. The Fire Department will have full access to the rear of the house and placement of this small storage building should not impede that access. Placement of the building as proposed will have no impact on adjacent properties. C. Staff Recommendation: Staff recommends approval of the requested separation variance. BOARD OF ADJUSTMENT: (JUNE 30, 1997) The applicant, David Fuqua, was present. There were no objectors present. Staff presented the item and a recommendation of approval. Mr. Fuqua offered no additional comments. The vote was called on the variance request. The vote was 8 ayes, 0 noes and 1 absent. 2
