Applicant's Statement: We are requesting a variance from the requirements of the Zoning Ordinance in order to provide covered parking for two cars at this residence. At the present time, there is a small concrete pad for parking just inside the property line. This block of Stonewall Road is extremely narrow with an open ditch without a curb and gutter on the opposite side of the street. Due to people parking on the street, it doesn't allow room for two cars to meet and can cause a dangerous situation. The proposed carport would move two cars away from the street and would provide for two additional spaces for visitors. This carport would be similar to the one two doors west both in location to the property line and architectural design. We are presently developing plans to upgrade the house and the carport would be in keeping with the neighborhood. June 30, 1997 Item No.: 4 (Cont.) Public Works Issues: Water jumps the curb on the south of Stonewall and this construction should not force the flows on to adjoining property owners. The rear construction should also be evaluated to ensure that this does not affect large drainage ditch capacity. B. Staff Analysis: The applicant is in the process of remodeling the older, R-2 zoned single family residence at 4603 Stonewall Road. Included in the project is a proposed carport addition to the west side of the house. The carport would have a front yard setback of 20 feet, matching the setback of the existing house and a side yard setback of 1 inch from the edge of the structure's guttering. The code requires front and side yard setbacks of 25 feet and 5.7 feet respectively for this lot. The property currently has no covered parking, only a small concrete pad just inside the property line. This portion of Stonewall Road is extremely narrow and does not safely accommodate on -street parking. The proposed 20 foot front yard setback matches that of the existing house and is architecturally more desirable than offsetting the carport an additional 5 feet. This variance should have no effect on adjacent properties. The applicant proposes to make the carport wide enough to accommodate 2 vehicles. This will result in a setback of 1 inch from the side property line. Although this brings the structure very close to the property line, the carport will be open and unenclosed which will allow for the passage of light and air as well as reducing the structure's visual impact. Due to the slope of the property, it would be difficult to accommodate the construction of covered parking elsewhere on the site and again it is desirable to provide off-street parking since Stonewall is so narrow and substandard at this point. 2 June 30, 1997 Item No.: 4 Cont. C. Staff Recommendation: Staff recommends approval of the requested front and side yard setback variances subject to the following conditions: 1. Guttering is to be installed on the carport to prohibit water run-off onto the adjacent property. 2. The carport is to be open and unenclosed on all sides other than at the point it adjoins the house. 3. Compliance with Public Works Comments BOARD OF ADJUSTMENT: (JUNE 30, 1997) Mac Core was present representing the application. There were no objectors present. Staff presented the item and a recommendation of approval, with conditions as noted above. Mr. Core stated that he understood staff's recommendation and asked the Board to approve the variance. He stated that Ms. Blakely, the neighbor adjacent to the west, had signed the plans indicating her support for the request. The Chairman called the question on the setback variance requests with the conditions as recommended by staff. The item was approved by a vote of 8 ayes, 0 noes and 1 absent. 3
