A variance is requested from the
setback provisions of Section 36-

After the property was platted in
1984, a flood study was completed
which covered a large portion of
this lot with floodway designation.

A regulatory floodway exists within the platted drainage
easement, which cannot be reduced until plan and cross
section information is submitted by a registered engineer
which demonstrates that hydraulic function of the floodway
will not be impeded by this encroachment.
Public Works Update:
The revised plan submitted by Joe White, Jr. on May 2nd
indicates both the residence and pool house must be elevated
to 414.0' to comply with the floodplain management
regulations, and is otherwise acceptable with Public Works.
The 25' floodway setback is not a requirement of the
National Flood Insurance Program, but is a local zoning set-
back. Public works has no problem with allowing a variance
from this floodway set -back in this instance, as access to
the ditch can be accomplished along the 20' sanitary sewer
easement shown.

B. Staff Analysis: '
#41 Valley Estates Drive is a vacant, R-2 zoned residential
lot in the Pleasant Valley Estates development. A 20 foot
utility easement is located along the rear property line and
a 60 foot wide floodway easement is located beyond that.
The applicant proposes to reduce the 60 foot wide floodway
easement to 40 feet which corresponds to the actual
floodway. The proposed easement reduction will be heard by
the City Board of Directors. A new residence, pool and pool
house are proposed to be constructed on the lot. The pool
house will have a setback of 0 feet from the floodway line.
Section 36-341(h)(2) a states "no structure shall be closer
than twenty-five (25) feet to any established floodway
line."
In issues related to floodway setbacks, staff depends
heavily upon the opinion and recommendation of the City's
Floodplain Administrator. The applicant has worked with
both the Planning Staff and the Floodplain Administrator to
address all concerns and to arrive at the revised plan which
is before the Board.
The residence and pool house must have minimum floor
elevations of 414.0 feet. An application to reduce the 60
foot wide easement to 40 feet must be filed with and
approved by the Board of Directors. A one -lot replat will
then have to be filed to reflect the change in the easement.
C. Staff Recommendation:
Staff recommends approval of the requested 0 foot floodway
setback subject to compliance with the following conditions:
1. Compliance with Public Works Comments
2. Approval of reduction of the 60 foot easement to 40 feet
3. A one -lot replat reflecting the change in the easement.
BOARD OF ADJUSTMENT:
(MAY 19, 1997)
Joe white, Jr. was present representing the applicant. There
were no objectors present. One letter of opposition had been
distributed to the Board members. Staff presented the item and a
recommendation of approval, with conditions.
Mr. White stated that he had no problems with staff's
recommendation. He stated that he had begun the process of
filing to reduce the easement.

recommended by staff. The variance was approved by a vote of
6 ayes, 0 noes and 3 absent.
