A variance is requested from the
area regulations of Section 36-254
to permit construction of an
addition with reduced setbacks.
Applicant's Statement: I am
asking for a variance in order to
add additional space to my house.
At the present time, my house is
approximately 835 square feet. I
would like to add an additional 577
square feet to the existing
structure for a total of 1,412
square feet. However, the
additional area to the east would
go farther than the allotted 10% of
the lot. Therefore, I am asking
for a variance in order to build an
addition.
The addition suggested will
encroach toward the property line
on the east. There will be 3.1
feet from the property line, and
3.6 feet from a fence on the other
side of an existing concrete block
border. This is more than what is
seen at this time due to the
present porch, which extends out
3.5 feet. My proposal goes out
3 feet to the east.
The reason for the request is due
to the existing doorway/covered
structure to the east, as seen on
the survey. I would like to
include this area for an increase
in living space; along with the
area behind. This would prevent
the manipulation of any weight

bearing walls on a house that was
built approximately 55 to 60 years
ago. There is a covered rock
porch, as seen on the survey, that
also already exists. This area
would also be included, plus an
additional six feet toward the
south. Therefore, the addition
would be built on top of structures
that are seen on the survey and
have been used for the last 55 to
60 years.
This addition is looked upon
favorably and was approved
enthusiastically by all the
surrounding neighbors while
discussing the variance for
signatures. I feel this will
improve the look of my house as
well as increase the value of those
structures in the surrounding
areas.

B. Staff Analysis:
The R-2 zoned property located at 4411 North Lookout is
currently occupied by a small (835 square feet), frame,
single-family residence. The owner proposes to expand the
home by adding a 577 square foot addition to the rear of the
existing structure. Access to the addition will be through
an existing door on the east side of the residence. The
structural design of this 55-60 year old residence would
make it very difficult to provide access from the existing
home to the addition at another point. To utilize the
existing door, requires the proposed addition to have a
setback of 3.1 feet from the east side property line. A
side yard setback of 4 feet is required for this lot. The
addition will have a reduced rear yard setback of
approximately 15 feet at the southeast corner.
Staff believes both the requested rear and side yard setback
variances to be reasonable. The requested side yard setback

variance of .9 feet is negligible and its impact is negated
by the fact that the addition is built over an existing use
area. A porch and a walled patio are located within the
area proposed for the addition. The applicant has stated
that it is structurally more desirable to utilize the
existing door on the east side of the residence. The
reduced rear yard setback is caused by two factors. The
house has a front yard setback ranging from 35-70 feet which
is well in excess of the 25 feet required by code. The
front and rear lot lines are not perpendicular to the side
lines, creating the unusual front and rear setback. There
is an alley located to the rear of this lot and many of the
properties along the alley have structures built right at
the alley.
Staff believes the reduced side and rear yard setbacks
should have no impact on adjacent properties.
C. Staff Recommendation:
Staff recommends approval of the requested side and rear
yard setback variances.
BOARD OF ADJUSTMENT: (APRIL 28, 1997)
The applicant, Blake Norris, was present. There were no
objectors present. Staff presented the item and a recommendation
of approval.
In response to a question from Chairman Alderfer, Mr. Norris
stated that the 20 X 20 "future addition" shown at the rear of
the property was only a concrete parking pad. Mr. Alderfer noted
that no structure was being approved for that location through
today's action.
A motion was made to approve the requested side
setback variances. The motion was approved by
0 noes, 2 absent and 1 open position.
