B. Staff Analysis:

The property at 14 Beverly Place is currently occupied by a
two-story single family residence and a detached, 21 foot by
24.5 foot accessory building. The accessory building has a
rear yard setback of 1 foot. The applicants propose to
remove the accessory building and to construct a one story
addition onto the rear of the house. The proposed addition
will contain a master bedroom suite, bathroom and closet.
The addition will have a rear yard setback of 5.8 feet. The
Ordinance requires a 25 foot rear yard setback for this R-2
zoned lot.
Staff believes the variance request to be reasonable. The
proposed addition is located in the same general vicinity as
the existing accessory building. The accessory building has
a setback of 1 foot and the addition will result in an
increased setback of 5.8 feet. There is a 10 foot wide,
paved alley behind the property which provides for
additional separation between the proposed addition and the
structure on the lot to the east. Staff believes the impact
of the proposed addition on adjacent properties will be no
greater and, in fact, may be less than that of the existing
accessory building.
C. Staff Recommendation:
Staff recommends approval of the requested rear yard setback
variance subject to the following conditions:
1. Compliance with Public Works Comments
2. The addition is to be limited to one story in height.

The applicant, Kathy Johnson, was present. There were no
objectors present. Staff presented the item and a recommendation
of approval, with conditions.

Ms. Johnson stated that she understood staff's recommendation.
She confirmed that the addition was only one-story in height.
Ms. Johnson stated that the large accessory building which is to
be removed was built in the 1930's as a utility room and maid's
quarters. She stated that her neighbors were pleased with her
proposed project, especially the neighbor to the rear.
A motion was made to approve the requested rear yard setback
variance subject to compliance with the two conditions noted in
the staff recommendation. The motion was approved by a vote of
7 ayes, 0 noes, 1 absent and 1 open position.

Applicant's Statement: We are
requesting this variance for the
addition to our residence, which
affects the setback provision of
the zoning code for the following
reasons:
• this location is the only place
possible to add this type of
space to the existing structure
due to the layout of the
existing house plan, and the
siting of the house on the
property
• the addition is a one story
addition and its height will
approximately match the
neighboring house to the north
as well as the height of the
structure it replaces - it is no
higher
• considering the built form on
the adjoining properties and the
alleyway separating them, this
location for the addition is in
the area most protected from the
neighbors.
