Z-6255 APRIL 21, 1997 This- memo is submitted in response to your request of April 15, 1997 concerning the attached letter from you. A review of the issue produces from City staff a response that says this development qualifies as a shopping center. The project consists of two lots that provide for separate ownership. However, the site plan and its several components such as parking and drives are interlaced to produce a common use area. These were reviewed and approved by the Planning Commission. It was realized at the time of creation of a special parking requirement for shopping centers that there would be those that have fewer spaces than if determined separately. There is no prohibition, in the Zoning Ordinance, against subdividing the center to permit separate ownership. Most developers are aware of the need to exceed city minimums for parking and those that do not provide additional spaces may have to limit leasing to those tenants that generate fewer numbers of cars. As you are aware there is no on -street parking in this area and parking on neighboring sites is controlled by poor pedestrian access across arterials or other busy streets. City Staff does not see this development as a problem for this comer, and feel it will function adequately, especially after signalization and street improvement at Autumn Road. The following statements are provided in response to questions and comments given at the Subdivision Committee meeting: 1. Right -of -Way Abandonment: My clients do not plan to initiate an abandonment procedure for excess right-of-way on the North side of the new Hermitage Road alignment. We will be working with David Scherer on a resolution for the Board of Directors that would secure a reimbursement for my clients, if the subject right-of- way is closed by the adjacent owner at some time in the future. We want to clearly express our concern to maintain rights to receiving the Southern half of said abandoned right-of-way, or payment in lieu of land, in the event this right-of-way is closed. 2. Signage and Lighting: Light pole symbols, signage, and descriptive notes have been added to the drawing. 3. Platting: Yes, we do intend to perform a lot split at staff level, following the approvals for zoning and site plan review. The proposed lot line and labeling have been removed per your request. 4. Vicinity Map: A vicinity map has been added to the drawing. 5. Autumn Road Entry: We formally request a variance to allow our Autumn Road drive to lie within 25' of the South boundary. This is supported by LRDPW to maximize the separation from the intersection. A note has also been added to the drawing. Waiver for Hermitage Road Improvements: We hereby remove our request for waiver of improvements to Hermitage Road. We have discussed the matter further with David Scherer and have agreed to a reduced street improvement obligation at Mr. Scherer's suggestion. The new proposal is indicated on the drawing. We also condition this agreement with Mr. Scherer's offer to assist in drafting and presenting the resolution mentioned in item number one. The recapture of old right-of-way value is important in offsetting the exceptionally large dedication required to realign Hermitage Road. 7. Public Works Comments: We understand the standard requirements stated in items 1,2,3, and 7 of this section of the Subdivision Agenda comments. We have revised perimeter sidewalks to five feet in width, as required (item 4). We have also stated previously our variance request on the Autumn Road entry (item 5). Mr. Scherer has stated he will withdraw his request for sidewalks North of Hermitage Road and we agree. We also agree that the right-of-way dedication shown is adequate and is accepted by the Traffic Engineer. 8. Sewer: We understand a sewer main extension will likely be required to service the restaurant building. 9. Water: Again, this developer does not intend to abandon the existing right-of-way, North of the new Hermitage Road alignment. Any water line relocation expenses will be relative to development of the parcel North of Hermitage Road. 10. Fire Protection: We have added a note to the drawing to express our understanding that fire hydrants will be required on site. I have not shown specific locations as we have not determined the exact way we will extend water service into the site. We will coordinate the placement of hydrants to meet the requirements of the LRFD. Buildings will not be sprinklered and will be constructed to meet the applicable fire codes for their usage/function. 11. We agree that landscape areas meet ordinance requirements with exception of the Western boundary. We have requested a variance to reduce this area to ten feet in width as the Land Use Plan designates the adjacent properties to be of a commercial use. RECOMMENDATION Approval CITIZEN None PARTICIPATION BACKGROUND The developers of Hermitage Commercial Center dedicated 9,070 square feet of right-of- way for relocation of Hermitage Road as required by the Master Street Plan. The abandoned right-of-way may at some future date be petitioned for closure by owners of property on the north side of Hermitage. The portion ( one-half of total) of the right-of- way which would revert to Hermitage Commercial Center would not be of sufficient size for development. Because of the large amount of dedication required for the relocation of Hermitage Road. Hermitage Commercial Center requests payment for that portion of the unused right-of-way which would revert to their ownership. The purchase price of the dedicated right-of-way was $10 per square foot. RESOLUTION NO. A RESOLUTION EXPRESSING THE WILLINGNESS OF THE CITY OF LITTLE ROCK, ARKANSAS, TO REQUIRE AS A CONDITION OF RIGHT-OF-WAY ABANDONMENT OF A PORTION OF HERMITAGE ROAD LYING WEST OF AUTUMN ROAD REMUNERATION TO ELIZABETH FIELDS WILLIAMS, TRUSTEE, AND SOUTHWEST RESTAURANTS, INC. NOW, THEREFORE, BE IT RESOLVED BY, THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City Board of Directors will require as a condition of a petition to close said platted right-of-way of Hermitage Road remuneration from petitioner to Elizabeth Fields Williams, Trustee, and Southwest Restaurants, Inc. c/o Tom Flores. SECTION 2. That said remuneration shall be equal to $28,130, which represents the square foot value of right-of-way dedicated for the relocation of Hermitage Road. Sixteen copies of the proposed site plan. 2. Completed application form. 3. Our check for $440 to cover the $200 site plan review fee, plus the $240 rezoning fee associated with this application. We have filed an application for rezoning with Mr. Dana Carney that accompanies this application for a comprehensive review of the proposed development. Two variances are requested for this application. The first variance involves an encroachment into building lines at the Northeast corner of the site. Corners of the structure are proposed to overhang the setback lines, however, the general average would easily equal the 25 foot minimum. The second variance involves a reduction in the land use buffer required at the Western boundary. The proposed landscape area is shown at 10 feet in width which will exceed the requirement for an adjacent commercial property, and a six foot privacy fence is proposed to screen the service drive area. A waiver is also requested for the cost of street and intersection improvements associated with this project. The proposed street and intersection improvements shown have been previously reviewed by the Traffic Engineer. The proposed right-of-way dedication is drawn based on the new alignment for Hermitage Road. The dedication totals approximately 9,000 square feet of a parcel that is currently under contract for sale at $10.00 per square feet. The owners and developer request this waiver due to the large amount of land area and resulting land value required for the street relocation. The land value is approximately $90,000 and the street improvements were estimated to cost approximately $38,000. A total cost of around $128,000 in construction cost and right-of-way dedication value is being requested for ±2.09 acre development. We agree the work is necessary to make the intersection function well, however, the large portion of this corner being lost to right-of-way is due to an intersection problem that was not addressed with the Chenal Parkway improvements. The owners and developer feel that their proposed contribution in right-of-way is substantial and much larger than more routine circumstances at an intersection might require. Therefore, we make this request that the City of Little Rock pay the cost of public street and intersection improvements at this location.
