Public Works Issues: Z-6248 Pebble Beach Corporation 1801, 1805 and 1809 Sawgrass Drive Lots 81, 82 and 83 Pebble Beach Estates R-2 A variance is requested from the building line provisions of Section 31-12 to permit construction of single family homes on each of these lots which cross platted building lines. The lots have an excessive slope which requires moving the houses forward. Vacant lots Single Family residences Repair curb and gutter and/or sidewalk damaged during or prior to construction with construction. B. Staff Analysis: These 3 lots are located in Pebble Beach Estates, a newly developing residential subdivision located south of Pebble Beach and west of Hinson Road. Several new homes are currently under construction although most of the area is still undeveloped. The front portion of the lots are level with the street. The rear half of the lots slopes upward at about 12%. The grade changes by approximately 20 feet, limiting the buildable area to the front of the lots. There is currently a 25 foot building line adjacent to the streets. The presence of the platted building line, when combined with the difficult terrain, makes it very difficult to construct a home which conforms to the architectural and square footage standards called for in the subdivision's Bill of Assurance. Therefore, the applicant is requesting that the building line adjacent to the streets be reduced to 15 feet, allowing more of the level portion of the lots to be used for ponstruction of the homes. The actual setback from the curb of the street will be 26+ feet, providing adequate sight -distance. Reduced building lines of 15 feet are not uncommon on hillside lots in the City. The houses shown on the site plan are illustrative and do not represent the actual homes which will be built on the lots. However, staff would encourage the applicant to use a similar design in which only the garage extends to the 15 foot line and the bulk of the structure stays behind the 25 foot line. Should the Board approve the building line variance, the applicant will have to do a one -lot replat to reflect the change in the building line. The applicant should review the filing procedure with the Circuit Clerk to determine if the replat requires a revised Bill of Assurance. C. Staff Recommendation: Staff recommends approval of the requested building line variance subject to the following conditions: 1. Compliance with Public Works Comments 2. A replat reflecting the change in the building line as approved by the Board. BOARD OF ADJUSTM : (JANUARY 27, 1997) Patrick McGetrick was present representing the application. There were no objectors present. Staff presented the item and a recommendation of approval. Mr. McGetrick stated that he agreed with staff's recommendation. He stated that he felt the homes could be designed as suggested by staff, so that most of the structure would be behind the 25 foot line. A motion was made to approve the requested building line variance as recommended by staff. The motion was approved by a vote of 5 ayes, 0 noes, 3 absent and 1 open position. 2
