Harpole 7214 Kingwood Road Lot 306, Kingwood Place R-2 A variance are requested from the area regulations of Section 36-254 to permit construction of an addition with reduced side and rear yard setbacks. The existing house has a 42 foot front yard setback. The construction of the addition as shown is more advantageous both architecturally and aesthetically. Single Family residence Single Family residence Repair of any curb and gutter or sidewalk that is damaged in the public right-of-way is responsibility of the property owner and would need to be facilitated prior to certificate of occupancy. B. Staff Analysis: The owners of the property at 7214 Kingwood Road are proposing to expand their home by constructing a large addition onto the rear of the existing house. The addition will align with the east side of the house and will extend to within 17 feet of the rear property line. The house has an existing side yard setback of 7 feet on the east side. The addition will maintain the same setback. The ordinance requires a side yard setback of 8 feet and a rear yard setback of 25 feet for this R-2 zoned property. The side yard variance is very minor and should have no effect on adjacent properties. The house is not located on December 23, 1996 Item No.: 2 (Cont. the lot parallel to the front property line. The result being that the proposed addition encroaches into the required side yard setback only at the point it joins the existing house. As the addition extends toward the rear property line, it angles away from the side property line. The proposed rear yard setback variance involves only a small portion of the proposed expansion. The majority of the new construction is located well behind the required setback. A large area of open yard remains on the property. The owner of the property directly to the rear of this site, who would be most directly impacted by a reduced rear yard setback, has stated that there is no objection to the applicant's request. The existing house has a front yard setback of 41 feet, greater than the 25 foot front yard setback typically found in Little Rock's residential neighborhoods. This has reduced the buildable area available to the rear of the house. C. Staff Recommendation: Staff recommends approval of the requested side and rear yard setback variances subject to compliance with Public Works Comments. BOARD OF ADJUSTMENT: (DECEMBER 23, 1996) The applicant, Katherine Harpole, was present. There were no objectors present. Staff presented the item and a recommendation of approval, subject to compliance with Public Works Comments. Mrs. Harpole offered no additional comments other than to state that she understood the Public Works Comments. A motion was made to approve the requested variances subject to compliance with Public Works Comments. The motion was approved by a vote of 6 ayes, 0 noes, 2 absent and 1 open position. 011
