Public Works Issues: Z-6228 Helen Sterley 1723 Pulaski Lot 6, Block 316, original City of Little Rock R-4 A variance is requested from the fence provisions of Section 36-516 to permit a 6 foot tall fence within the required setback. A building permit had already been issued for the fence and work had begun on the job when the applicant was made aware that the fence did not comply with the code. The fence is well back from the street and should not impact any other properties. Single Family residence Single Family residence Repair of any curb and gutter or sidewalk that is damaged in the public right-of-way is responsibility of the property owner and would need to be facilitated prior to certificate of occupancy. B. Staff Analysis: The owner of the property located at 1723 Pulaski is proposing to enclose a portion of the property with a 6 foot tall, combination chain-link and wood fence. The property is a corner lot which has a side yard relationship to West 18th Street. The applicant proposes to place the fence on the property line. Section 36-516(b) states •fences erected within required setbacks adjacent to streets shall not exceed 4 feet in height." The required side yard setback for this property is 5 feet. Since the applicant December 23, 1996 tem No.: 1 (Cont. wishes to erect a 6 foot tall fence within the setback (on the property line), a variance is needed. Staff believes the variance request to be reasonable. The fence will actually have a setback of 15 feet from the curb of West 18th Street and will not create a sight -distance problem. The property is several feet above the grade of the adjacent streets. The applicant was actually issued a building permit for the fence on October 7, 1996. It was not until construction had begun on the fence that the City advised the applicant that the fence did not meet code and stopped the project. C. Staff Recommendation: Staff recommends approval of the requested fence height variance subject to compliance with Public Works Comments. BOARD OF ADJUSTMENT: (DECEMBER 23, 1996) The applicant, Helen Sterley, was present. There were no objectors present. Staff presented the item and a recommendation of approval subject to compliance with Public Works Comments. Ms. Sterley offered no additional comments other than to state that she accepted staff's recommendation. The question was called, including the condition offered by staff and accepted by the applicant. The vote was 6 ayes, 0 noes, 2 absent and 1 open position. 2
