Penney, Jr. #11 Robyn Lane Lot 10, Pennwyck Subdivision R-2 A variance is requested from the building line provisions of Section 31-12 to permit construction of a house which crosses a platted building line. The presence of two, 25 foot building lines on this corner lot reduces the buildable area available without a variance. Vacant lot Single Family residence #11 Robyn Lane is located in a newly developed residential subdivision, south of Taylor Loop Road and east of Montgomery Road. Several new homes are now being built in this small subdivision. The applicant proposes to build a new, two-story residence on the lot at the southeast corner of Robyn Lane and Montgomery Road. The proposed house will encroach across the platted 25 foot building line on the Montgomery Road side. The lot has platted 25 foot building lines on both the montgomery Road and Robyn Lane frontages, reducing the buildable area available. The applicant desires to provide the required 8 foot side yard setback on the east side. Erue to the presence of the two building lines and the applicant's desire to maintain the required side yard November 25, 1996 No. : 3 (Con setback on the east, the proposed house will not fit on the lot without a variance. The variance affects the Montgomery Road side of the lot. The proposed house crosses the building line by 2 feet in one area and 4 feet in another. At the point where the encroachment is greatest, the house will still sit 38 feet from the curb of Montgomery Road. Montgomery Road is a 1,400± foot, dead-end street with very little traffic. The reduced setback proposed by the applicant will not impact traffic on the street and will not be that visually noticeable. The property across the street is sparsely developed. It is currently occupied by several outbuildings and a horse f arm. Staff believes the variance request to be reasonable. if the Board approves the building line variance, the applicant will have to do a one -lot replat reflecting the change in the building line as approved by the Board. The applicant should review the filing procedure with the Circuit Clerk to determine if the replat requires a revised Bill of Assurance. C. Staff Recommendatio : Staff recommends approval of the building line variance subject to a one -lot replat reflecting the change in the building line as approved by the Board. BOARD OF ADJUSTMENT: (NOVEMBER 25, 1996) The applicant, James Penney, was present. There were no objectors present. Staff presented the item and a recommendation of approval, with conditions. Mr. Penney offered no additional comments other than to state that he had no problem with the staff recommendation. A motion was made to approve the requested one lot replat.
